Now I suppose it’s all in the wording but there’s now precedent in the UK for crowdfunded campaigns to make it easier to get their money back if someone fails to deliver.

As odiferous as I find @Babuinix to be, in this particular instance he is correct; when you pledge to this project it is no longer "your" money, it is CIGs.
It is now on CIG to be responsible with that money and uphold their end of the contract. If they don't, there is recourse regardless what it says in the TOS (consumer protection laws trump corporate policy).
Edit: read the TOS anyway. Carefully. Even if it wouldn't hold up in court (hypothetically) you have to know what you are getting into at the time of the transaction. This is assumed.
I am not a lawyer, but I do have a M.B.A. My tip is don't spend anything on this you aren't 100% willing and ready to lose.

And what is with the shooter they randomly pulled out anyways? Decided they had too much money and decided to push back development even more by making some random stuff with it?

Maybe. However the judge spoke from the position that the backer was a consumer and so was protected by consumer protection rights. After that it was just a case of sorting through the small print which attempted to insulate the company against consumer protection laws (aimed at stopping people being ripped off).
