This may sound odd, but I have a co-worker whose mother lived nextdoor to the guy who made the video and saw the entire incident. This was a totally messed up situation and I hope this "cop" goes to jail for a long time.
Both driver and passenger had been drinking which lead to the eventual chase and crash so definately a bad situation to be a part of. What they did was wrong and they should be punished for the choices they made, but what insued with the cop was unexcusable.
The video shows most everything that went on but overall the victim was being totally cooperative before everything started, and no threatening gestures were made. After the shots were fire and the camera man left, the cops went to his house to preform an illegal search trying to find the tape. The cops finally stopped after the news reporters showed up. The cops are trying to cover this by bringing up the fact that the camera man had an outstanding warrant back in Florida.
I can't believe that a man who served his country and was put in harms way (whether he fought or not) and then comes home to get shot. This is just wrong and it is just another example of a few crooked cops (maybe more than a few in the southern California area) giving the good ones a bad name ( and there are good ones that I know personally),

ya but the officer said ok get up...... telling the man to get off the ground and the airman made no aggresive moves.
that is a level 5 aggression according to police standards for maybe a level 2 situation.......

Should the man die, I hope they try him for MURDER (in the first degree). He deserves nothing less. If he doesn't die, then ATTEMPTED MURDER.
If he wasn't deemed intellectualy capable of either, then he should be locked up in an asylum for the rest of his life, since even a 5-year-old could have made a better decision.

The Video Tape is very dark and grainy, and its really hard to see exactly what he is doing with his hands when he is trying to get up. if he was putting his hands on belt or anything in the process then its really hard to know. The police officer will give his testimony, then we'll see what happens. Its going to be very hard to convict him though, because the picture is very dark and we can never know exactly what the guy did to make him fire.

Not only bad quality film but the sound was just as grainy and bad. I think there was even a beep before the cop said get up. It could have been don't get up, we wont know, that is why you have to take video tapes like that with a grain of salt.

Exactly. But if he said get up, and shot him 3 times he should time. But it seems to me a deputy wouldn't shoot a suspect 3 times if he isn't scared or something. I would like to know crystal clear what they said and what happened.
Things like this have been going on in the metropolitan areas and outlying suburbs for decades now. But we never hear about it when young black men on hard times get shot by law enforcement. Scratch that. We hear how the police are blameless in many cases. I remember one case where an artist from Iowa was shot dead in his parent's garage for doing nothing.
If some good can come from this, its to raise awareness that this sort of thing happens all too often to decent people of all walks of life.

Im sure hell get booted off the force but i think hell be able to avoid prision time if the guy lives
