    Respond to the Notice of Abandonment by filing one of the following petitions:

    1. Petition To Withdraw Holding of Abandonment (See laws and regulations Manual of Patent Examining Procedure 711.03(c) I) and 37 CFR § 1.181). No fee required.

    Where an applicant contends that the application is not in fact abandoned (e.g., there is disagreement as to the sufficiency of the reply, or as to controlling dates), a petition under 37 CFR § 1.181(a) requesting withdrawal of the holding of abandonment is the appropriate course of action.     Damn, I wanted some Darkfall action figures

    I especially wanted the Tasos doll.  Everytime you pull his string, a new lie comes out of his mouth.

    Why don't they just change the name if it's that much of a hassle?  Could be something like "Fall of Darkness" or something.

    There is no hassel. This is simply showing they didn't feel it necessary to TM the Darkfall name. Once you have the TM it is really no problem keeping it up. It costs nothing. Why change the name? More of a hassel to TM a new name.

    Fan or no Fan of DF, still gotta wonder why let the TM go if they are planning on launching in 08.

    Sure there is. They've been trying to get that trademarked since 2003 and still don't have it. 

    This is simply showing they didn't feel it necessary to TM the Darkfall name.

    The one they abandoned is a different one. They still have the other (which is suspended) and has had all the problems since 2003. Two different markets. That's why the one they abandoned was allowed through.

    Fan or no Fan of DF, still gotta wonder why let the TM go if they are planning on launching in 08.

    The trademark for the Game itself though still says live.  Its the trademarks for everything else that was let go.  Wonder if it could be part of some publishing deal.

    Hi, I looked at this in detail not long ago. There was a previous fantasy computer game called "Dark Fall" that was published in the late 1990s I think. Obviously that would mean it would be a trademark violation for another company to make a fantasy computer game called "Darkfall". So they got their applications rejected right away. It is strange, but the people at Darkfall thought they could get around this for a while just by working the beaureacracy correctly. That never happened, but what did happen is they eventually negotiated with the original trademark holder for "Dark Fall" fantasy video game, and got them to waive their rights to the trademark and allow Aventurine to [basically] take over that registration without protest. So, basically Aventurine bought the trademark rights from the ones who already owned that trademark, because it seems unlikely that the company just waived their rights away for free.



    As for the one that was abandoned, I forget what the deal was with that one, but anyway it doesn't really matter, because the trademark that they have successfully registered covers what they would need it to.



    FWIW, the fact they worked out this trademark situation and apparently bought the rights to the Darkfall trademark from the previous trademark owner is probably the strongest [only?] evidence to date that these developers actually have a game on their hands that might possibly release.

    The one and only.
