The trademark for the Game itself though still says live. Its the trademarks for everything else that was let go. Wonder if it could be part of some publishing deal.
Hi, I looked at this in detail not long ago. There was a previous fantasy computer game called "Dark Fall" that was published in the late 1990s I think. Obviously that would mean it would be a trademark violation for another company to make a fantasy computer game called "Darkfall". So they got their applications rejected right away. It is strange, but the people at Darkfall thought they could get around this for a while just by working the beaureacracy correctly. That never happened, but what did happen is they eventually negotiated with the original trademark holder for "Dark Fall" fantasy video game, and got them to waive their rights to the trademark and allow Aventurine to [basically] take over that registration without protest. So, basically Aventurine bought the trademark rights from the ones who already owned that trademark, because it seems unlikely that the company just waived their rights away for free.
As for the one that was abandoned, I forget what the deal was with that one, but anyway it doesn't really matter, because the trademark that they have successfully registered covers what they would need it to.
FWIW, the fact they worked out this trademark situation and apparently bought the rights to the Darkfall trademark from the previous trademark owner is probably the strongest [only?] evidence to date that these developers actually have a game on their hands that might possibly release.
