I've sent my response to them, and once again demanded a phone number to resolve the issue with a person in real time, rather than waiting for bloody emails to come through. If they don't respond with a reasonable response this time (As you can't get the game in it's CE state in the UK at the moment) I'll go through trading standards tomorrow.
Whilst UK law does indeed state that the retailer is the one responsible for the product should it not be suitable for sale, the retailer can not be held responsible for the error of the manufacturer directly and I'm entitled to a working product from either the retailer or the manufacturer. I've found a US phone number for someone at Funcom, but I'd rather not spend a fortune on international calls if I can avoid it.
This is very poor customer service indeed. What's making it worse is that they obviously know that it's an issue, and they're just fobbing it off as the retailers fault (when if it was sealed, how could it be?). I know someone at funcom will have a phone at their desk and I will get my CD key from them.
Installed, patched.. ready to play, try to register my CE edition key and get this message...

Receieved this email today, after sending them proof of purchase:
"Hello, I am sorry however you have shown my proof of purchase of a used
Game. I am sorry but you need to contact the person who sold you this
game, or contact amazon for a fraudulent seller. As you have bought, a
used copy of the game. And we are unable to assist you with. You need to
take this up with the seller, and the medium you bought it threw. As you
have provided me a Cd-Key that is already in use."
To which I replied that I have sent you a proof that clearly states on it "New and Sealed" This is rediculous. If anyone here feels like bombarding them with emails, it'd be appreciated.

Well the emails have stopped completely. They've not responded to my last 3.
I've contacted the retailer, who has been very, very helpful - whilst he has no stock to get me a key, he's contacted the Eidos rep, who has escalated the claim for me. He's also given them the contact details of Failcom (thanks ) and given me his personal mobile number so I can get in touch with him out of hours.
If a small indy shop can have such awesome customer service, why can't a company? If I get to keep my 'dead' key and get a new key through eidos, I'll still be after a replacement key for the dead on because if they're going to rip me and the retailer off, then I'm going to rip them off.

Dude this is fate telling you to take the game back while you still have a chance. This game SUCKS man. Like hardcore real bad.... if you are bored waiting for something else to come out, Try Ryzom its free and requires you have more than 2 neurons firing in your brain, but its fun if you give it a chance.
Science fiction aint my scene, but thanks for the recommendation - I always like to look out for good free MMO's. The reason I want to play conan is for a bit of simple, brutal, fun. I'm not looking for anything in depth until darkfall comes out - and I have low expectations of that, because I know it will not be anywhere nears as good as Ultima Online ever was (once) and no MMO at the moment is close.
The extra key will go to my flatmate who also would like to play, and I don't hate her
