Greetings!



I am giving this warning to all as I do not wish anyone else to have to go through what I am right now with Aventurine!



Six months ago my younger brother's account was banned.  This is not the problem.  The problem is AVENTURINE continued to charge him a monthly fee up until this month (June) and will not refund the monthly fee's which were charged after the account was banned!  Aventurine went on to state that unless you remove your billing info they will keep charging you! Potentially even if you cancel your sub!



I give this warning to all who will heed it as I am now entering a legal battle with this company over a mere $74.95 USD.  If you want any more direct information about this or this has happened to you please respond and I will have you added to the case file.

For all of you talking shit, this was just sent to me.  I'm not a troll, I'm not a bro, I'm a Software Engineer. This issue has now been resolved.  Oh and I still play DF.

Edit: Oh and for all of you who saw the reasoning, and know how law works in the EU and in the US for these companies thanks for having my back in this. I told everyone the account was banned because I'm not personally trying to hide anything, and you all have no idea the resoning why the account was banned, it was not for a 3rd party program so I could teleport all over the world.  I

    Show proof of the account banning date to your credit card company and they should approve a chargeback.

    Only talking with a lawyer will cost you more. I dont think you are entering a legal battle. And, just and advice, check your bank account often, not every six months.

     becuase we have much more important things in our life to worry about. in fact I forgot I got a letter about some class action law suit where I might get around $500 I need to follow up on that.

    Anyway, the info is good to know I am being very honest about that. But the rest of it, I really dont care mistakes get made and to be frank not all players are the brightest apples in the bunch so I cant assume what the poster is saying about his actions toward canceling is even accurate.

    because AV is nowhere at fault...

    I was myself banned from another mmorpg, and would have continued charging my fees, had I not checked!:)

    same, with another different company, happened to a friend of  mine, who realized it after a couple of months

    so I assume it is common practice....but:

    NOW: I live in EU where laws can be different, but being this last one close friend to a lawyer, he asked friendly if he could sue the company, was told he had no chance, apparently it was all right by the law!:(

     Hmmm I'm no lawyer but I don't see how a company can discontinue it's services to you while continuing to charge you money.  I know there are certain provisions written into contracts and such that can penalize you but a direct charge for services not rendered?  And there isn't much that you can't sue someone over it's all in how you word it.  No whether you can sue successfully or not is the question.  As for the op smart dumb whatever it's not my call but I don't see how he can't just dispute this with his bank/cc company if he can show them that he has not recieved services from AV there is no way AV will get to keep his money and that's a far cry from and much easier than actually paying a lawyer yourself to waste time on such a simple matter.

    I'd also like to add that I don't think this is even a common practice, if it were stories like this would be much more common with all the mass bans we see throughout mmo's and if I remember right AV was one of the companies to run one of these mass bans (not one hundred percent sure though).  It sounds to me like a mistake they made and it may then be policy for them to dispute whether they can keep the money or not but I don't think they as a standard practice continue to charge for services no longer given.

    but yeah, to call this game Fantastic is like calling Twilight the Godfather of vampire movies....

    PLayers pay a subscription fee to have access to the companie's services, in this case to play a game. When the customer is blocked from using the service, no more charges should be made.

    This is a goof attempt to get an easy buck if you ask me.

    If his brother hacked the companie's software then good, a ban seems right. But charging someone that isn't a customer anymore is shady at least.

    Hiring a lawyer its going to cost you, hope it is worth it.

    This shows hat some companies can't be trusted at all. Too bad for the indutry and for the gamers.

    Did you get a notice that you got banned or kinda? I mean because of the time when you get banned. As you could use when you get in contact with the bank or paypal etc as it should proof enough to get money back.

     

    Getting banned is one thing, but getting charged while being banned is kinda scamming.

    there is an option for continuous billing that you must have had checked, you fail.

    You have already lost this legal battle. They wouldn't do what they did if the fine print didn't explicitly give them permission to do so. Read your EULA's very carefully kids.

    There are consumer laws that trump EULA if a credit card is involved and charges without service.

    Agree. I'll never understand why certain people always want to give companies precedent over people. Companies are artificial constructs with NO intrinsic -meaning, or value- people on the other hand have basic meaning and value. Life matters, artificial legal entities do not.

    This actually happened to my friend. However he was not banned, he canceled his account AND removed the billing info. Aventurine kept atttempting charges on the credit card for the following month. All of which were rejected as the CC company required authorization for over sees charges (this was back when it was just EU1). His account was then banned at that point for the billing issue. Upon submitting a petition  to Aventurine, they replied with a generic response stating he had to pay them to unban his account. 2 peitions later they said his account was banned for hacking (note this is a month after he had canceled the account) he never hacked, but it was nice change up from the other generic responses. They still continued to try and charge his CC despite the fact that the billing info had been removed. Aventurine are nothing but criminal scum, this should have been made blatantly obvious to the general population after they charged NA players twice for the game if they participated in the EU launch despite Tasos confirming no less than 5 times that they would not have to and that AV would facilitate their transfer to an NA server (free of charge). 

     

    Sadly me and my friend had intended to return to the game after a break. However that will never happen,  all the lies from Tasos throughout the developement and beta process, in addition to CC scams and fruad is just to much.

    Here's a short phrase to look up in your favorite Wiki since none of you know how to use an actual valid reference source:

    Punitive Damages.....

    Now it may take months to actually pursue a civil action, and he has to hope that they don't get nailed on a criminal charge first which shuts the company down, but compared to what SV is doing with their ninja billing this is a minor infraction.

    Well, that they continued to charge the banned account was probably just a mistake, wouldn't be the first or last time in MMO history. this forum is full of threads about that in different games.

    But refusing to return the money really sucks. In every other thread when the company messed up (usually Mythic but there have been many others too) the company refunds the victim ASAP.

    Anyone can do a mistake, it is humans who do the work but not correcting such a thing is bad.

    The OP came on and gave a friendly warning and showed zero hostility towards the game and still he gets slammed? i was actually browsing these forums because i was thinking of coming back! i even started a htread asking if i should but at the moment i have to say....i have been put right of joining up again lol.......please someone post and let me know that this thread consists of the minority of DF players as i cant join a game with such a community!

    Sorry for the nerd rage but it's made me so angry reading this thread as this is about the 1000th time i have read about this same problem and still the op is made out to be a liar lol!
