Didn’t he first make a video about how it’s a slam dunk for CIG and then later on when he saw how others were getting ripped apart he decided to tone back his response?
He follows the case, CIG at first plays strong with bringing up the GLA and the MtD (when he said that), then both parties argue with each other over it on several fillings, then he tempers his view after seeing the arguments and information both parties put up to support their case.
No because the CIG knights will try to crucify you to your channel and probably stop watching right after and you’d lose revenue.
However if you take CIG’s side and your video is all about how the judge fucked up or how Cryteks lawyers are just reaching for anything then you will have an already rabid fan base watching your videos which will lead to revenue plus you will more then likely have said rabid fan base throwing money at you because they love that you are siding with CIG.
So yes money totally plays into the equation and sets the bias.
Oh lol, every piece of controversy and drama about SC gets high views, not the opposite, just see the media outlets always with negative press on SC always trending.

And the fact is, most of the views given on this whole lawsuit from informed people, do overall favor CIG and not Crytek in multiple points... Well, the way am reading CRYTEK and responses from CIG, I feel sorry for Max and others, because it's really starting to look like things are going CRYTEK's way. I believe Max and others really had faith in Roberts telling the truth about how Star Citizen/SQ42 was being produced.
It would be hard for anyone to start realizing they well could have been duped. Not saying they were just starting to look that way.

I think I’d rather take the boring end of the deal and go play completed and fun games then be a backer paying for CIG to drag out a lawsuit as long as possible and waste as much money as possible on lawyers fees

Dragging hurts Crytek too. The court is a gamble, nothing is guaranteed there and we have no lack of examples of when things get ruled against everyone's expectations, especially in America, hence why settling cases as this is a standard thing.

Dragging it out can exhaust the other sides ability to pay their lawyers, who charge by the hour.
I suspect Cryteks abilty to survive is seriously at risk and this strategy may work.

See the calculated costs of the company show their costs are easily more than what they crowdfund yearly, so unless they are going to layoff people to outspend Crytek in court, I don't see it.

The biggest surprize in the Motion to Dismiss was the note on one of the items dismissed by the court. It essentially was taking Crytek's side by writing the amendment for them and saying (without actually saying) that the court will rule in Crytek's favor if they submit the amendment. Courts usually do this if they are unhappy with the other party; (CIG in this case) and is absolutely legal.
Unless there is a last minute settlement, we are going to get a court case out of this. Which means all the process that precedes it; including Discovery.
LoL good luck with that "discovery" . Again nothing will come out of this except nice fees for the lawyers to feast on.
As usual the haters throw a party because they think this will be the end of Star Citizen and when the dust settles nothing comes out of it, the game keeps being developed and making millions in the process.
