what legal claims? when was this email sent?

Roughly 3 months ago.  However, I'm not exactly rolling in cash right now and no lawyer would take a peek into all my claims without a few thousand.  So I sent you an email trying to find out exactly what ideas of mine were "borrowed" from Mr. McCall and to figure out what to do about it.  If you'd like to PM me your email address that you check I'll be happy to draft up another email for you and keep things a bit quieter.  Believe it or not, I'm not trying to rock the boat, I just want to make sure that my hard work was not improperly used by another individual.

    Hey Shrubber,

Was Indentity51 one those harrassing you about ToC?  Because I've never
been PMed by another user until I made an off-hand comment on the hype
page saying that ToC will never see the light of day.  Then lo and
behold Indentity51 PMs me with all these qutoes from articles about
ToC, to show me what's what I suppose.  It always struck me as quite
odd that someone would write a lengthy PM in reponse to a short fifteen
word critizism on the hype page.

I believe Indentity51 is the same guy that uses lot of different names
here in MMORPG.com, just to laugh at other games and link TOC after
that. Funny thing is, I was actually ready to give these guys a second
chance and then they (probaply one of their staff members) go and do
something like this lol. Needless to say, my interest of their game
went out the window. So, I went to TOC Hype-Meter and wrote that it's
just another vapor title. This is the responsse I got from a guy named shmeagle (I'm willing to bet my  kidneys that Indentity51 and shmeagle is the same guy):

"Who is developing Thrones of chaos?

Thrones of Chaos is being developed by Loud Ant Software LLC based
in Portland , Oregon , USA and is composed of a tightly knit group of
seasoned professionals who have recently opted to come together and
form their own company focused on the MMOG industry. Many have been
involved in the gaming industry for years and have held past positions
at such organizations as SOE , Blizzard and EA and have been involved
in some of the higher profile titles such EverQuestII , Lineage II or
World of Warcraft as either coders , artists or designers bringing with
them an indispensable wealth of knowledge.

go buy a clue you ignorant monkey..

I am going to laugh my ass off when this game goes into beta and owns ignorant suckers like you."

Do they really think that this sort of business strategy is going to bring them more customers?

Now we are talking about a massive loss of reality.

Boy, you should go out and breathe some fresh air. You spend too much time in front of your display.

Yes, well. After reading your 7 (all for Mourning) posts and seeing that an original Mourning fanboi has come to ToC's defence, I'm not overly concerned about your opinion. But I am glad you posted, because I've been looking all over for the thread about the original Mourning being removed from this site  MMORPG.COM News: Mourning Removed 3/22/05 11:37 AM  and Mourning- Unethical Business and Horrid Game 6/27/05 5:54 AM , and your user info provided it for me a year and 5 months after your last post defending it. Thank you, and do have a nice dayimage

It's so obvious that they (LoudAnt) use these fake accounts to try and defend ToC, but ti just makes them look even worse (if that's even possible).image

Oh well, this your only response?

Firstly be assured that my account is no fake account, I have nothing to do with LoudAnt but following the game and it's possible progress.

I'm not a fanboi in that way you would like to see me. You can't discount every critical comment about your behaviour by calling it "fanboi" though you do.

Stick to facts and stay away from insults and flaming ... IF you can do so

Then why haven't you posted in over a year, and only in a ToC thread? Anyone can look at your post history and see you are a fake account.

Hehe, really? You can SEE it? Way to go!

I think I don't have to discuss whit you why I post when or where.

What response were you looking for?

fact: the account you're using hasn't posted here in over a year and a half, and those six post were in defence of Mourning.

Now,you make a comment to me about a "massive loss of reality" toward a very logical post I made and then make the same tired reference to my time in front of the computer as another person today in this thread who had no greater comeback than that.

Was that all you wanted to resurrect the account for? To try to insult me? Okay, well then your job is complete. You may go now.

The thing I don't believe is that someone could still be a fanboi of this so-called game. If you are just a fan (and we know you aren't) how could you still believe that this game will ever be released? Did you read this thread? Can't you see this game will never see the light of day? Why defend it, it's pointless? imageimageimageimageimage

*shrug* If you think so. If you can read it right you will see that it was not about defending Mourning but accusing the way Mourning has been attacked.

We have a very different view of "logical". I already said what kind your logic looks to me.

There was no need to try to insult you. You do it yourself the best way anybody else can do.

Did I say I believe that? Show me where and you may call me a liar.

Neither I defend this game nor I can't see "this game will ever see the day of light".

The fact is: I don't know whether this game will succeed or not. I'm following the progress and that's it. It's a long time ago I lost my believe in this game, but that doesn't bring me to the state to flame it. Is that acceptable to you?

Heh, as you say, we have differing views. Well, I guess there's nothing for us to do than agree to disagree, then. Take care.

On a different note, I would like to know if Draaken's complaints to MMORPG.COM, as referenced here It is everytime the same guy starting this flaming attacks. I mentioned that several times to the mods of mmorpg.com, but till nothing happened, were lodged in an official capacity (as in MMORPG.COM was informed that it was someone from ToC complaining) or by Draaken  only appearing to be a regular member of this site. Perhaps that can help determine if ToC team members are posting here using shadow accounts so as not to appear as having any involvement with ToC.

Why do you complain about this post? Is it wrong? I don't think so. Do you feel insulted or are you just trying to find anything you can complain of?

In fact, Draakan is not a member of LoudAnt but a german follower of this game. He is a Mod on the board and that's all.

From my point of view he is not official as he gets infos only a little bit earlier than all others - sometimes later image

You're right. He is a mod for the ToC forums. Which, whether you like to see it that way or not, makes him an official member of the ToC crew. And why does my complaining about Draaken's post bother you so much? You are getting pretty damn defensive for someone that has no interest in defending ToC, or in the game for that matter. Oh, other than to follow it's progress, of course.image

It's called public relations, whether it's paid or not. There is a big difference between being a mod for a public forum that hosts information for hundreds of games and represents none of them (unbiased) and being a mod who represents one company and one game in particular (biased).

However. My English is not good enough to discuss definitions.

I would call him official if LoudAnt declares him to be. And that I can't imagine.

Well then, I really must compliment you, as you have made yourself clearly understood and your spelling is superb for someone not native to the language.image

As far as LA declaring him official, he did that when he made him a mod. Everything Draaken says on those forums is official. As you may note, there is no disclaimer in place on the posts he makes, as there are on the mods posts here.

Edit: your spelling is even better than mine at timesimage

Didnt read the whole topic, but just doing short reply for Brian.

Brian, i dont know how it is in your country, but in my country, if there isnt a real contract, the one making up the stuff/idea's blablabla has automatically copyright on it.

Do you need to register stuff to get it copyrighted in the states?

At the moment of writing this text, i already have copyright on this text in my own country hehe.

Dont have to do anything for it.

So if they are using your input, then are they not breaking any laws already?

Here in the States, there is a rather complicated procedure requiring registration of you idea and filing a patent and copyright for it.

A couple of loopholes would be: writng down and describing in detail your idea, the specs of whatever it is and so forth, putting it in a package and mailing it to yourself. As long as you don't reopen it, it can be presented in court as proof of your being the creator of it, due to the U.S. Postal mark on the package. To an extent, you are right about posting something here as being almost the same thing, with the site having time and date stamps, etc. However, that is a less than secure way of doing it because of possibility of hacking, server crashes, rollbacks, etc. ocurring.
