Thing is, it'll be pretty obvious when someone is hanging around trying to bait you into hitting them. if you have a decently positive alignment, just kill them and take their stuff.
This game will probably atract afew WoW kids after 1 month (soo they can get a nice ebay char),then they will gank all they long.
Oh there will be ganking and griefing. For some people that is the *only* reason they even log in.
And there will likely be eBay characters.
Only flaw in your logic is that this has been going on in open PvP MMOs since long before WoW came out and many of the so-called "WoW kids" even knew what a MMO was.
No one MMO has a monopoly on idiots who log in only to gank and basically make others miserable.
Though the brunt of them have tended to gravitate toward open PvP MMOs with few restrictions and lootable corpses and/or gear that drops on death... as few as there have been.

As with all MMOs, beta testers are going to have a huge advantage at the beginning. I know they need beta testers to help with the code, but it does seem a bit unfair to those who do not get to participate in betas. Just an observation.

Can't answer that until I've played it for myself.
All I can say is that in every single MMO I've played, the majority of players take the easiest route to money, skills, rewards, etc.
So, the Devs. job is to make sure that the desired play-style is the easiest route. It really is that simple for them. Not that it's simple to achieve... but the goal itself is fairly straight-forward.

How long will a person have to travel to get to the nearest Enemy Faction?
How long will they have to travel to find the nearest player they think they can kill?
How easy will it be just to wait and let your players come to you? (At banks, bind stones, vendors, etc.)
The answer to those questions will most likely have a bearing on the outcome.

I predict the majority will just be wanting to get the skills they want up to the max as soon as possible.
THEN they will worry about faction and start making trips over to the Enemy.
To begin with... anything that can be killed that will give a skill-up is fair game... Faction be damned!
It's been discussed that the experienced players will prey on new players making them not want to continue.. FACT: The penatly for killing your own kind is a faction hit. FACT: If you hit someone in your own faction, you become grey (meaning anyone in your own faction can kill you and not take a faction hit) FACT: Every attack aside from archery, is an AOE attack. Discuss.
You are from the same school of thought that advocates school sports days where everyone gets a gold medal and the "sports" are non competitive. Don't deny it, thats what you want. You like games where victory is guaranteed as soon as hand over cash for the game disk.
Some people think that games should have winners and losers and that this should be decided on merit, in this case merit being twitch skill, being better organised, clever use of games mechanics, having more spare time ect. all the things that you don't like and refer to as griefing or ganking. Some of us want to play a game where this the case and do not want to be awarded victory unless we deserve it within the context of the game. Winning or losing is not the point, it is the competition that matters and we are gracious enough to accept defeat and still enjoy the game. Sounds like you aren't so it's probably best to look somewhere else.
Guild A likes alignment exploiting and making own faction go gray so they can kill people for free.. they do this to members of guild B, C, D, E and F.. so B, C D, E and F declares war on A and go gank em nonstop with no penalty.. guild A gets bored and quits game..
or same scenario, just one person going on killing spree.. But Guild B, C, D, E and F are heavily into the real pvp.. so allmost everyone is at +100 alignment score.. a -8 for killing person A makes no difference so they kill him on sight.. person A gets bored and quits game..
i could even imagine no-lifers getting a second account so they can make an enemy faction player just to go gank the offenders..
ofc some people will find this funny no matter what, but im shure the problems involved wont make it worth it for most people

Actually for a bussiness standpoint, and this has been pointed out before, but the niche market with this purely pvp style mmo might put off new players if the beta and/or release players become expert gankers... don't get wrong, I'm all for DF and looking forward it, but he does make a point in that you may alienate say prospective players 2 or 3 months after release
Howerver I'll give this a go if it gets favorable reviews after launch regardless of all the gankers playing.
