It was released to the live game servers but as a test mode. Basically now there are far more many DX10 cards available they needed a wider audience to continue to optimize it. Therefore there is a choice for people to play the game in DX10 but this side of things is still a release candidate. Many people are getting good results. However, overall opinion is that it still needs tweaking such as the SSAO option which puts to much of a haze on things, grass can look weird.
Here are some 10 min youtube videos I made in DX10:
Drunken Brawling is not in this update, at the moment they are focusing on other area's deemed more important.

No Public ETA given as they have freyed from that now and adopted a done when it's done approach.
So best guesses are anything from 3 weeks + away. I think at least a month. There has been several iteration updates to the patch, so progress is going good and fast. They could also implement parts of it, such as the RPG update first and then a few weeks later Tarantia Commons (high end faction based zone, new tough dungeon etc).

Looks like the next update will be a good one, latest news floating around regards to PvP Experience from Minigames:

PvP Exp for minigames for patch 5? Completed it today. I'll see what else can be done
Wow havn't played aoc since release but this patch is definately gonna make me resub for at least a month. Very excitred to experience these updates. Looks to me funcom is sorry for what they have done and they are trying real hard to gain customer loyalty back. Well I don't hold grudges can't wait till it goes live!!!
They all want to ship the best patch possible on the fastest timescale, and they meet frequently to evaluate the current project against the potential improvements they could continue to make. When the quality, usability and performance are solid enough to be called final (as judged by everyone involved in making it) they’ll release it.

My guess is the patch will coincide with the anniversary.

Couple more updates that happened - May 8th and Today:
* Fate (the leveling NPC outside of Tortage) will now give out Straw Dummies that you can test your damage on.
GENERAL
* Path of Asura is now obtained at level 4, instead of level 1.
* Many more improvements have been made to the Tarantia Commons district.
* Female characters should now be properly dismembered during fatalities.
* Shield of the risen is no longer given when players are resurrected by other players.
* Shield of the risen should no longer run out while a player is still zoning.
* Player pets now have more hit points.
* Permanent pets will now include their owner's bonus magic damage from attributes when gaining their trickle-down dps bonus.
* You should no longer stand up on your horse when casting spells.
* You should not fall down to the ground when casting spells in spellweavemode anymore.
* Many fixes to Dx10Test have been made.
* Fizzle chance - 100% Fizzlechance will once again silence you correctly (and gray out spells on the shortcutbar).
CLASSES
Assassin
* Necrotic Leech's particle effect should now properly move with the character as intended.
Barbarian
* Butcher IX will temporarily use the same animation as Butcher VIII to circumvent a damage-scaling issue.
Conqueror
* All ranks of Breach will now share a single animation to make higher ranks more viable in situations where time is of the essence.
* Devastate now increases Hail of Furious Strikes damage by 1/2/3/4/5% (down from 2/4/6/8/10%).
Dark Templar
* Leech Life IV has had it's combo-starter changed from LR to UL.
* Leech Life V has had it's combo-starter changed from LL to UL.
* Leech Life VI has had it's combo-starter changed from LR to UR.
* Dooming Presence's fear effect is now breakable by Agile Mind.
Demonologist
* Fixed multiple issues with the Demonic Warlord pet not correctly getting the bonus for all ranks of pet-augmenting feats. Fixed an issue where the Demon Familiar pet was not getting the bonus from rank 1 of Fury of the Underworld.
* The demons the Demonlogist can summon have new textures.
* Fixed a bug with the Overload Feat making Inferno of Amher overwrite itself when it reached a stack size of 2.
Guardian
* At level 10 you will now gain a new ability - Reckoning. You will be able to use this immediately after using a Flashing Arc, Disable or Storm Strike combo to inflict damage on the target, or around you in the case of using it after Storm Strike. If used after Disable, you will regain some stamina. It is intentional that this only works with pole arm combos. All existing guardians will get this ability when they next log in. It inflicts more damage when you are in frenzy stance.
Herald of Xotli
* Hell Strikes VI should now play the proper animation on Female characters.
* Rage of Xotli reduced to increase the damage of Hell Strike by 1/2/3% (Down from 3/6/9%).
* Inferno curse now applies Elemental Ruin instead of Elemental Wrack. It will not stack with the debuff applied through Molten Steel Slash etc. Cooldown has been increased to 45s.
* Bonds of Anguish has been removed and replaced with Chains of Anguish. This is a short duration, fast casting damage over time spell. When the damage triggers, that target and any others between the target and the herald will take damage. There is a synergy between Chains of Anguish and Clarity of the Mad, in that while Chains of Anguish is running, you will gain a 33/66/100% resistance to stun and fear effects based on the number of feats in Clarity of the Mad.
Necromancer
* The Blood Arcanist pet is now able to properly trigger Cabal. Fixed the proc rate of Cabal for the Archmagus pet (it was way too low). The Blood Arcanist pet now correctly has its AOE radius increased by the Empowered Archmagus feat, just like the Archmagus pet.. Corrected the proc rate of Spiritual Torment gained from the rank 1 and rank 2 Grim Hunger feats for the Blood Arcanist and Archmagus pets (it was too low).
* Corrected an issue with DoTs to ensure that you will always get all ticks off each spell.
* Frenzy should no longer interrupt pet actions.
* Pets should be a lot more responsive after killing their target.
* The attack command should always lock nero pets to the selected target even if you are in assist mode.
* Particle effects in Necromancer pet spells should no longer appear long after the "throw spell" animation.
* All Necromancer caster pets now have casting animations.
* Gelid Bones will now show the damage in the tooltip for both minions and non-minions.
Priest of Mitra
* Exorcism cast time has been reduced to 1 second.
* Spellweaving for Priest of Mitra should now work the same as Demo and Necro spellweaving. When rank 6 is reached, you should always have 6% magic damage increase initally (excluding other beneficial spells triggered from spellweaving). This will gradually scale up to 25% magic damage increase for every refresh of spellweaving rank 6.
Ranger
* Heavy Bolts should increase the DoT damage on Flesh Ripper.
Tempest of Set
* Fixed Empowered Cobra Stare. It now correctly lowers the break chance by 33/66/100% .
* Cast time of Storm Nimbus has been reduced to 1.5s.
* Spellweaving for Tempest of Set should now work the same as Demo and Necro spellweaving. When rank 6 is reached, you should always have 6% magic damage increase initally (excluding other beneficial spells triggered from spellweaving). This will gradually scale up to 25% magic damage increase for every refresh of spellweaving rank 6.
GUI
* Added a new chatgroup for a pet damaging an enemy's stamina/mana.
ITEMS
* Amulet of Lycophos can now be sold to a vendor.
MASSIVE PVP
* Relocated a siege camp in Sturmgarde, to allow the battle to spread out some more.
* Players in a massive pvp battle will now receive the correct points in the chat log.
* Some holes have been closed in the battlekeep Burnheim.
* Battlekeep buffs should properly get removed or transferred when a building is gained or lost.
* Battlekeep buffs will no longer stack.
PVP
* Guards now respond differently toward player combat. If you initiated PvP combat and run to the guards for help the guards will attack the aggressor instead. Guards do not mind if you kill criminals in front of them. All guards have been provided with ranged weapons so they are more effective at defending innocent bystanders. Guards will now mark anyone as a criminal that they engage in combat.
* You will now get a buff telling you that you are aggressor when attacking another player.
* Guards have increased damage and massivley increased hit points.
* AoE spells should now only affect targets which give murderpoints if your current target will also give murderpoints. This applies even if your current target is not within range of the AoE spell. This means targeting a low level player in front of you and casting a ground targeted AoE spell far away will cause low level players far away to be hit because your current target, though unaffected by the spell, would cause murderpoints if you were to hit him.
TRADESKILLS
* You now get feedback when trying to slot a gem while in combat stance.
WORLD DESIGN
* Purple Lotus Swamp should appear a bit brighter at times than it has been in the past.
* We have lowered the DPS of monsters to better match the feel of player survivability on Live. This change was done across the board, at all levels. All solo monsters in the world are now nerfed a bit in DPS. The goal of this was so the "strength" of the player when playing version 1.05 is equivalent with how it is on Live with the same level and quality of gear.
* Damage done by raid mobs and raid mob hit points have been increased a bit.
* Cennyn in Connall's Valley will now also sell level 30 food and drinks.
* Corrected the animations for the Atzel Captain in Atzel's Approach.
* The Martyr of Votantha encounter in Xibaluku has been nerfed quite a bit.

Well all I can say for my experience is don't even try it
Switch to DX10 mode and ran fine but a bit slow so I decided to lower a few setting which caused the game to crash taking down my PC with it. Fine its still kinda beta so switch back to DX9 and crashed again, reboot try again same issue. Gave up with AoC at this point and try another game same thing crashes out as soon as anything 3D runs.
At this point I have cleaned down and reinstalled my driver and reinstalled DX but am still getting the same issues in all games, so basicly until I can find a fix my PC is trashed

Things are ramping up and picking up speed.
There was yet another update today:
TESTLIVE
* The Straw Man should now have correct mitigation of 3% instead of 30%+. We have also removed shields from the dummy, but keep in mind that the damage represents what you normally would do when hitting a 1 shielded side.
GENERAL
* You can once again see sent /tells in your chat window.
COMBAT
* Multi-hit combot will no longer cause a desync when interrupted by fear, charm, or knockback.
CLASSES
Herald of Xotli
* Flame Lash has been changed from a combo into a spell. When you train the Flame Lash feat, you will now receive a spell. This spell has a long range, hitting a single target.
Necromancer
* The duration of Despoil the Soul has been increased to 1 hour. (Up from 12 minutes).
* Cannibalism has been improved. The amount of mana gained has been increased by 25% for each rank. It is now instant cast. The cooldown of the spell has been lowered to 2 seconds.
GUI
* Players can now decide not to show their equipment. If equipment inspect has been disabled, the option for it will be greyedout.
* Buff-activation borders now won't affect characters in group or characters close to you.
* You can now take screenshots as JPEG with Alt + F11 (This is setup default, but you might have to change your own settings if you have that key combo bound to something else).
GUILD
* Deleted players will now be removed from their guilds.
PVP
* You can now no longer attack raid members in the border kingdoms.
PvP Minigames
* Minigames will now give a PvP XP reward at the end of the game. This reward varies between the winning and the losing side, and scales per minigame tier.

Sorry to hear you had issues. Personally over 3 PC's with multiple set up's never had the game crash.
Have you run the repair tool? Also CCleaner is good for registry fixes.
I only played during my first 30days one month after release and left. Was heartbroken mainly cause the whining and moaning in chats, the stability, content...
Also RP, or lack of. "PVPtards" (I use that term for the "ha-ha-rpers-suck-pvpers-rule" mentality) claimed that lvl 70's ganking lvl 10's in the tortage dungeons was rp due to the setting of the Conan universe. I grew up with The Conan comics of the 60's as my father was a huge fan and had all the comic books. I was excited for the rp possibilities..
Apart from content and stability changes... has the player base improved? Does RP exist?
And, on a side note: I was a Herald of Xotli and it bugged the crap out of me that I went from pretty female to huge, hulking MALE demon that looked like some bad parody of a body builder. I see "new, more frightening appearance!" in the notes.. but am I still flash changing from female to male? >_<
* Players can now decide not to show their equipment. If equipment inspect has been disabled, the option for it will be greyedout.
Wow, in a world where ppl have the right to know your spec, gear and the last 4 didgits of you SS # this may have sold me. Captialism still has a few days left, ima make the best of it. Not cuz my gear or I suck but because players that have to know what you have for gear or spec to beat you to compete can kiss my ass!!!

I can safely say that it won't be next week (anniversary or otherwise, we wouldn't rush it out for a reason like that)
Another build has been built for the test server this evening (the folk here are working extra and hard to get this update polished) and I am sure it won't be the last build for test before we consider moving the update to the live environment.
That said we are getting closer, and I don't think the update is that far out. Of course something might still crop up, but things are progressing nicely and I think we are happy that things are starting to come together. If all goes well then it's possible we might be a few weeks away. We certainly won't push it out if we don't think it's ready.
Of course I expect that there will be something that isn't quite right and we will need to make some post-updates tweaks and even changes. The feedback from the test servers has been great so far, but there is always something that slips through or doesn't surface until the masses get their hands on it. We are prepared though and getting ready for the challenge

Yet another update got patched in on the test server today!
* Non-combat companions, from dogs to ancestral spirits, are now abilities. Once learned, these abilities appear under the "Companions" ability tab, no longer taking up inventory space. When summoned, these companions will remain by your side until you enter combat, send them away by using the ability again, or summon a different companion to take their place, or until 15 minutes have passed.
* The difficulty on group monsters has been increased.
* Blood on the ground will now be displayed properly.
COMBAT
* Several issues causing pets to stop attacking have been fixed.
* Pets will do splash damage as it is described in the tooltips.
CLASSES
Assassin
* Burden to Bear now applies the Physical Torment stacking Armor debuff.
* The proc rate of Burden to Bear has been significantly increased.
Dark Templar
* All long term buffs have had their durations increased to 4 hours.
Herald of Xotli
* Changed Thundering flames effect from being a 1s silence to an interrupt effect.
* Hell on Earth and Tongue of Xotli have swapped places in the feat tree. Tongue of Xotli is now a possession feat, while Hell on Earth is an Avatar feat.
* Hell on Earth has been changed. This now grants you an instant-cast spell that creates a zone on the ground that gives you (and any other Herald that has Hell on Earth trained) a large increase in Combat Rating (fire) while you remain within the zone.
* Tongue of Xotli has been changed to a cone spell, rather than a targeted column spell. Its damage has been increased.
* Knowledge of the Underworld has been changed, and now just gives an increase to magic fire damage.
* Hatred of the Living has been changed to increase the damage of Hellfire Breath by 2% per rank.
* Word of Command spell now only has one rank, gained at level 13.
* The base damage of Inferno has been slightly increased. Additionally, Inferno gains an increased benefit from bonus magic damage based on the Flame Lash counter. Each Flame Lash counter grants an extra 2% coefficient to Inferno when it is cast. Inferno has a new particle effect to better signify when you have it running.
Necromancer
* The manacost of Pestilential Blast has been lowered.
* The manacost of Flesh to Worms has been lowered.
* The manacost of Mark of the Devourer has been lowered.
* The manacost of Grip of Death has been lowered.
* The damage caused by Chill when it detonates has been increased. The coefficient of this spell has been significantly increased, so it scales very well with bonus magic damage. The mana cost of Chill has been slightly increased.
Priest of Mitra
* Emanation of Life will no longer cost extra mana to cast when Light of Mitra is active.
Tempest of Set
* Changed Thundering voice so that it now interrupts spellcasting and applies a 4s silence effect.
GUI

* Fixed spell rank and name sorting in the spell book.
* Spells on your shortcut bar that you do not have in your spellbook anymore are removed when logging in (and receiving the spellbook).
ITEMS
* Most of the level 80 Armor sets have been tweaked and balanced. This includes the Raid tier 1 and 2 sets, the PvP sets, and the Dungeon Tier 0 sets. NOTE: This does not include weapons.
QUESTS
* Tarantia Commons : Player will no longer see an exclamation mark over Cantrix after receiving the Enemy Movement quest.
* Tarantia Commons : Enemy Within - Players must now first find the rooftop, before targeting Velonus.
* Tarantia Commons : Fighting Fire - Updated the waypoint for Fulvio. Added coin and xp reward to the quest.
* Tarantia Commons : Walking the Plank - Fixed a problem where the solved text did not show up.
RAIDS
* Made it easier to reach the specter of Leviathus.
* When disbanding from a raid after a teleport, your teamlist will now show.
PVP
* Guard placement in all outdoor adventure playfields has been reviewed and adjusted where needed.

* The Buried Man has been renamed Telius.
* Added an option from the smuggler in Tarantia Common District to travel to Old Tarantia.
TRADESKILLS
* Corrected the goal text of several crafted items (ex. Moonsteel Throwing Axe became Moonsteel Throwing Dagger) to better reflect the item you actually make to advance the quest.
* All items with gem slots now show them even if they are empty.
* The Ancient Souls feat has been changed to "Spell - Ancient Soul". In addition to its previous effects to increase the lifespan of Parasitic Soul pets, this feat now grants the Ancient Soul spell. This spell inflicts unholy damage on the target and causes a Parasitic Soul pet to be summoned.
Demonologist
* Fixed a problem where the Overloaded Shockblast feat was not increasing the chained damage of Shockblast (Rank 1).
Ranger
* Debilitating Aim now also increases the duration of the Crippling Snipe debuff by 2/4/7 seconds per respective feat point to a total duration of 15 seconds.
* The Booby Trap trigger radius has been slightly increased.
* The Ricochet feat has been revamped. It will now give the Ranger a chance on attack to apply a 10% snare to his current target. This snare bypasses crowd control immunities. Further feat points in this feat increase the chance to apply this snare effect.
* The Knee-Capping feat has been replaced with a new ability called Knee-Capping. This ability is an instant clickable snare. The snare percentage and duration both increase when investing a second feat point making it on par with Pin Down. The ability costs stamina to activate.
* Tendon Rupture now increases the duration of the Knee-Capping snare by 1/2/4 seconds per respective feat point.
* The damage from Sulfurous Burst has been tweaked up slightly. The damage will increase will your level.
* Clear the Field now increases the duration of the snare applied by Incapacitating Stabs.

* Shattering Stance no longer procs knockback or AoE damage.
* Shattering Stance now increases your Weapon Damage (Ranged) by 25% and your Armor Penetration by an amount based on your level.
* Terror Totem has been replaced with Concussive Blast. Training this feat grants an instant cast point blank AoE stun that affects up to 4 targets within 3 meters for 0.5 seconds. Investing feat points increases the duration of the stun by 0.5s per point up to 2.5 seconds. The ability has a 90 second cooldown.
Assassin
* The Unholy Armor-feat will now give Unholy Stance up to 50% bonus armor.
Priest of Mitra
* The Armor of Faith-buff will now give armor instead of physical invulnerabilities.
Tempest of Set
* Improved Overcharge has been removed and replaced with the feat "Spell - Prison of Souls". When you or your team make a kill, the tempest gets a one hour buff that increases the damage of lightning strike, lightning sparks and storm field by 1/2/3/4/5%. This buff counts up to 3, although the increased number does not increase the damage bonus. When the buff counter is at 3, it enables you to use the new Prison of Souls spell, which consumes this buff stack and grants you the Spark Storm buff, which lowers makes Lightning Sparks channel faster.
COMBAT
* Combos which do a given damage per second for their hits, depending on the duration of the hit, will now have their damage shown correctly as "damage per second".

Holy Crap!
Another update, that makes 3 this week!
The ones in RED are particularly decent parts!
CLASSES
Demonologist
* Increased the cast time of Storm Chains to 0.5 seconds.
* Reduced the duration of Storm Chains to 10 seconds.
* Increased the cooldown of Storm Chains to 40 seconds.
Herald of Xotli
* Fire Pits spawned by the Tongue of Xotli spell should no longer be susceptible to crowd control effects.
* Avatar Feat: The Flame Cleave has been changed to no longer trigger a damage ability behind the target you hit. It will now passively give you Combat Rating Fire instead.
Guardian
* Guard Destroyer now applies the Physical Ruin debuff (-15% physical invulnerabilities)
* Guard Destroyer cooldown increased to 45 seconds.
Ranger
* Flame Barrage should once again apply the Blistering Wounds effect.
Tempest of Set
* Casting Life of Set should now always remove the Disrupted Charge debuff.
CONTENT
* White Sands: The outlaws have packed up their camp and moved to a more appropriate location.
* It should now be easier to pick up The Phoenix of the North.
* The quest Walking the Plank in Tarantia Commons can now be solved properly.
* Tarantia Commons: Players can now turn in the bottles to Ateno, when doing the Whining Merchant quest for the second tme.
* Gave the Pirate Shirts and the Rat Hood in Tarantia Common District proper names.
* Lacheish Plains and Border Kingdoms, Cimmerian End have been optimized to improve client framerate when playing in these playfields.
* Massive PvP: The area around the keep in Fort Bane has been adjusted to improve balance during a siege.
COMBAT
* Non-boss raid monsters have had their health significantly lowered, and their damage slightly lowered.
* The armor and protection feats in the general trees have been rebalanced, mostly resulting in smaller values
GUI
* The owner's name will now be displayed in the combat log when a pet does damage or casts a spell. If the pet is yours, the combat log will say "Your <petname>"
* Fixed the resizing of the font when changing resolution.
ITEMS
* All PvP armors have been polished and rebalanced.
* All mounts are now abilities. Once learned, these abilities appear under the "Mounts" ability tab, no longer taking up inventory space. These abilities work in the same way as the items did - if unmounted, using a mount ability will mount you upon that mount. If mounted, the ability will dismount you.
Worst thing so far in AoC is poor class balance at lower levels, potentially making your gameplay experience hell at the start. Rangers are godlike until level 40 (stealth+the ability to track other players+best CC of all classes+very high dps=every degenerate lifeform picks one to gank other classes 24-7), while Guardians are fairly poor below level 30, and Assassins only become good at level 70+. Same in PvE, some classes can take on 4-5 mobs at once and easily kill them, while others struggle fighting 2 mobs at the same time.
Comments
I do not know about PVP yet, so I cannot comment on that aspect of the game. Quests are there I know that much.
Here is a cool video of a Seige in AOC in HD. Make sure you select the HD version when you click the link. You will find the HD option on the player on the right side there. Its is cool and looks like so much fun!!

Wow, even with my ancient "rig", this patch has me really excited. Lots of nice changes and additions there, massive update to say the least.
I just might have to resub or check out TL using a trial account (if that is possible?).
Maybe I missed it, but I didn't see the DX 10 upgrades, or the drunken brawling. Is DX10 already in the game?
It was released to the live game servers but as a test mode. Basically now there are far more many DX10 cards available they needed a wider audience to continue to optimize it. Therefore there is a choice for people to play the game in DX10 but this side of things is still a release candidate. Many people are getting good results. However, overall opinion is that it still needs tweaking such as the SSAO option which puts to much of a haze on things, grass can look weird.

As well as a potential reworking of Guards in the game; "There are some changes to the guards coming in the next TestLive update"
Stacking BK Invuln's : "I believe this is fixed in the next build." (may not get in, in time for 1.05 though, but there is a chance)
Now Playing: Guild Wars 2/ Diablo 3
When it's ready.
They all want to ship the best patch possible on the fastest timescale, and they meet frequently to evaluate the current project against the potential improvements they could continue to make. When the quality, usability and performance are solid enough to be called final (as judged by everyone involved in making it) they’ll release it.
In other words, Soon(™)

TESTLIVE
GUI
* Added a new chatgroup for a pet damaging an enemy's stamina/mana.
Added May 11th, 2009
--------------------------------------------------------------------------------
GENERAL

Spoils of War - The quickest way of ending a war is to lose it.

COMBAT
* Multi-hit combot will no longer cause a desync when interrupted by fear, charm, or knockback.

* Cannibalism has been improved. The amount of mana gained has been increased by 25% for each rank. It is now instant cast. The cooldown of the spell has been lowered to 2 seconds.
GUI

GUILD
* Deleted players will now be removed from their guilds.

Sorry to hear you had issues. Personally over 3 PC's with multiple set up's never had the game crash.
Have you run the repair tool? Also CCleaner is good for registry fixes.
Sounds like graphics card driver issues maybe.
Question...
A little update here from the Game Director:
15th May 2009,

Added May 19th
--------------------------------------------------------------------------------
GENERAL
* Non-combat companions, from dogs to ancestral spirits, are now abilities. Once learned, these abilities appear under the "Companions" ability tab, no longer taking up inventory space.
