I know you've been told by some to avoid Darkfall, but in my opinion it has the best PvP in an MMO at the moment. At lest out of the ones I've tried. I have yet to see any exploiters although I hear some still exist. I've only been PKed once and have managed to escape from three other PKers, all of which were nice adrenaline rushes. The graphics are decent, but graphics has never been a major point for me. The UI does need some help, but hopefully that'll get fixed later. There's an upcoming expansion that looks to make the game much more enjoyable. And with the influx of EU players into the NA server, there's a lot of PvP going on.
If you really can't bear to try DF, then you might wait until Mortal Online comes out. It's still in beta at the moment, and from what I hear it has a long way to go before it's really playable, but the devs are working hard on it.

Well my initial reaction would be to try out Darkfall, however I was uncertain so I asked a second opinion from a well known authority on PvP and a high level PvPer himself,

Helloes, I am very dissapointed in AoC and am actively looking for another MMORPG to play. However, AoC set the standard pretty high with the combat system (personal opinion of course) and I could not go to a game where you point and click. Priority is PvP but I hear so much conflicting information about different games... here are some examples
- Vanguard is pve and crafting - Warhammer is huge fail - Darkfall same as Warhammer - LOTRO is mostly pve - Fallen Earth is First Person - Champions Online is action packed but very very unbalanced - WoW is .... ya well
so I can't think of many others out of the otp of my head, there's always DotA (or HON) or FPS, but I really enjoy the RPG part of pvp also
So for you, and not necessarily from the list I provided above, which is the most PvP oriented MMORPG (and is not a total failure)? Cheers,

ignorrant t*at. darkfall like warhammer? not even close! darkfall is centered around pvp and the dynamics that influence pvp battles and sieges. warhammer most usually uses instanced pvp zones... they are totally different, not even to speak of gameplay! those bad friends of you that played probably didn't even want to try to learn it, it has a steep learning curve, like most of the people. im no fanboi of darkfall i don't even play it anymore, but comparing it to warhammer is like comparing a frog to an asteroid field.

The question is are you willing to Lvl/grind to reach the PVP? In AIon for example the first 25 levels are all based around PVE, after that the game is supposed to open up in the sense that it becomes mostly about PVP. (only played open beta)
Fallen Earth: the same deal though it's not until later in the game you will really be able to PVP. Fallen Earth is both 3rd and 1st person, the combat is similar to a FPS with rpg elements. (cb tester and ob, some trial time after release)
Eve: if you're in a corp you can PVP from the start yet you will not be very effective until you have had some time under your belt. Though in my opinion the combat is very slow it's more about tactics than it is about action. (few trials)
WAR, is a fun game to an extent. Being able to PVP from the very start is a nice addition to the MMO genre IMO. The problem is once you reach t2-3 the population severely dies off until you reach t4 which means you may need to pve grind in between some section of game play. There are also still quite a bit of performance issues as well, not to mention huge lay offs within the company. (subbed for some time)
Guild wars: All about the PVP similar to war yet performance is much better as is the population. It's similar to AOC in how the world is set up. Though combat is nothing like AOC's.The pvp is in tournament form which makes it quite interesting all the way up to an international lvl. (own it)
DAOC: one of the best PVP games ever IMO, it is dated however. The premise of the game is all about warfare, with working sieging and full on open world PVP. Great experience if you ask me. Now that they have consolidated down to one sever cluster population shouldn't be a problem. Though I must point out you really should expect a little learning curve. The controls and player control will feel pretty archaic, given the age of the design.(played over a year)
That's about all the help I can give on PVP games haven't tried the others you listed. Though I'm thinking about giving DF a try sooner or later.

I'm mostly a PVP MMO player, the few I currently play are: Warhammer Online : They have an infinite trial, give it a shot. Lineage II : The PVP has consequences, item loss and exp loss. Guild Wars : Isn't really much of an MMO, just PVP. Enjoy! Also you don't have to be so selective, most MMO's out now actually have trial periods.

Now I wait for the calls of "fanboy" etc, but here is honestly what I think :
Funcom sucks, AoC is full of bugs, server is empty, zones and battle keeps crash, classes are not balanced, the devs are the slowest I have ever seen (and I mean slow), there is no content and the mods on official forums are nazzi volonteers.
Still, it's the most fun PvP I've ever had so far.

Can't disagree, as you basically said AOC isn't even a great game, it's how bad the rest are that makes it one of the few I can tolerate at present. It's a shame how devs approach PVP, as if we're the bastard children of the genre. I just don't like FPS games enough to continually play them as I like a bit of RPG in any game I play.

For a PvP MMO you cant go past Planetside, its accutally quite friendly to newer players since level =/= power, only versitlity, you can kill a level 40 player at level 1, you can even have the same guns an armor as him, you just cant have asmany guns, that and NO PVE, ONLY PVP.

Yes, it's mostly 1st person unless you're using a melee weapon or harvesting. Then it switches to 3rd person. If you really hate 1st person, then you probably should skip DFO.

I've played several pvp based mmo's since I started playing in the UO era, and I haven't found a game that keeps me as entertained and challenged since Darkfall came out.
Sadly Darkfall seems to be getting a lot of negative press, some of it well deserved from issues arising with AV's retarded release attempt.
This game isn't the same game your friends played 6 months ago, or even 2 months ago.
One thing that has impressed me after playing Darkfall from release is that the Developers, as close lipped as they seem to be with communicating back the the player base as they were at first, are improving the game play experience almost bang on with what we are suggesting through the forums.
Recently Av hired several community correspondents that help transfer information back and forth from the devs to the player base. It has been refreshing to get new updates almost daily from them on their progress with the games development.
The game itself has grown leaps and bounds in the last 6 months alone, and the newest expansion (or patch as every other mmo calls them) promises more pvp balancing, less grinding overall and a more diversity over the basic cookie cutter combos, all without "locking" your characters into set classes or having to regrind up a new one.
I don't play games for graphics, I play them for pvp game play #1. And hands down, I consider darkfall's pvp system one of the best I've seen since the glory days of UO.
Risk vs reward in pvp, skill based combat, no auto tab or targeting systems, no enemy radar, and believe it or not, I have seen less hackers/exploiters in this game then most other mmo's I have played. (this includes speed hackers in warhammer and wow) For the first time in over 2 months I encountered a speed hacker trying to kill me in darkfall, I reported him swiftly to a GM and within two minutes he was banned and the gm told me he was taken care of permanently. I have rarely seen this kind of GM response in any game, any where else.
This is one game that has started with baby steps, but is NOT going to be laying down to die any time soon.
Goliaths like Conan, warhammer and now possibly even Aion are released, but the gameplay is never there, and possibly never can be, so the player base quickly spikes down to next to nothing.
I find myself one of the worst people for condemning games before I play them based on bad reviews or personal bias, but this is definitely a game you have to play before you bypass, especially based on the style of gaming you enjoy.

Planetside was the greatest MMO PvP experience Ive had in my ten years of MMO gaming. Eve is probably the best active game out right now for that, but unless youre already playing Eve theres not much oppurtunity for new players to enjoy that PvP.
Mortal Online looks like its going to be a good game that is releasing this year since it will be awhile for Planetside 2.
Sony are apparently working on something to do with the planetside IP. perhaps even planetside 2.
as for future games, im gonna try to stay away from fantasy games. I obviously like pvp games, thats why from planetside i went to WAR and then to Aion, but im not really for the limitations of a fantasy MMO. the class systems, the whole gear and resists evade dodge deals, equipment and grinds...bleh.
Things I loved about Planetside:
>3 faction combat, 2 factions is simply stale 3 makes for good pvp and diversity in the fights you have.

>no classes, you can do everything on one character, within its cert limitations, while i like group play in fanasy MMOs you NEED to have a group, tank healer, DPS CC to get shit done. or you may aswell logoff. in Planetside you can roll with whatever you got. 3vs50...yea you can still kill them.

So trying to find a game with those features i think Jumpgate Evolution is the best match. though netdevil dont have the best track record, what they have currently is looking okay. MORE INFO ON IT WOULD BE GOOD THOUGH, K THX.

I think AoC had a great combat system myself, does Champions Online even have pvp outside of an arena?
Lots fo MMO's have some good pvp, but I see none as taking the crown atm.
Only thing I'd suggest beyond what's already been discussed is Aion. Never tried it myself.

Since original DAOC, only Darkfall holds my interest for PvP, and it just gets better and better.
Forget what some haters say : try it for a bit
After the first few weeks toughing up your character, you'll start holding your ground on PvP clashes.
Prepare for some heart beating, adrenaline rush fights ( 1v1 up to Epic )
Edit : just noticed the OP doesn't like first person point of view. ( same as everquest )

I find myself one of the worst people for condemning games before I play them based on bad reviews or personal bias, but this is definitely a game you have to play before you bypass, especially based on the style of gaming you enjoy.

WTB Planetside sequel
Planetside 2 please!!!!!!!!
Planetside was the greatest MMO PvP experience Ive had in my ten years of MMO gaming. Eve is probably the best active game out right now for that, but unless youre already playing Eve theres not much oppurtunity for new players to enjoy that PvP.
Mortal Online looks like its going to be a good game that is releasing this year since it will be awhile for Planetside 2.
Hijack:
Sony are apparently working on something to do with the planetside IP. perhaps even planetside 2.
as for future games, im gonna try to stay away from fantasy games. I obviously like pvp games, thats why from planetside i went to WAR and then to Aion, but im not really for the limitations of a fantasy MMO. the class systems, the whole gear and resists evade dodge deals, equipment and grinds...bleh.
Things I loved about Planetside:
>3 faction combat, 2 factions is simply stale 3 makes for good pvp and diversity in the fights you have.
>sci-fi
>no classes, you can do everything on one character, within its cert limitations, while i like group play in fanasy MMOs you NEED to have a group, tank healer, DPS CC to get shit done. or you may aswell logoff. in Planetside you can roll with whatever you got. 3vs50...yea you can still kill them.
>"skill" based combat not "ability" based combat.
So trying to find a game with those features i think Jumpgate Evolution is the best match. though netdevil dont have the best track record, what they have currently is looking okay. MORE INFO ON IT WOULD BE GOOD THOUGH, K THX.

Check out Mortal Online. It's build around PvP, but still will have a good PvE. It is focus on real player skill than just levels.
