The agreement is over a number of years if EA defaults on the agreement it still has to pay Gamesworkshop the entire amount they are owed, EA can not just walk away and hand back the IP at no cost. Gamesworkshop could possibly work out an agreement to take it back but it would still have a cost to EA.
As long as WAR is current break even, aka laying off 40% of Mythics staff, cost cutting in other area's like getting rid of a lot of the scenerios to reduce server blades, and the game can break even, or even if it is still losing money but less than it would cost to close it down it will remain up. Even if they never recoup the investment in the game to make a profit it ends up being a cost measure for EA.

You look at one factor, your own hatred towards the game and thus make it and the developers sound bad in every opinion you state. When presented with facts you go the opposite of a fanboy and try and fault the game and everything they say or do for it. Fair enough, and it even sounds rational. But, unfortunatelly, this is not the way how companies invest money into IPs. Even in the case of such a way more popular IP as Star Wars we had to and still have to 'wait' for looong years till coming back... (but apparently not with the classic trillogy's era...)
But to follow your metaphor: this (not-so-old) building is still not torn down, it's definitely seems to be a fine place to live in for quite a lot, and it even could be renovated here and there
I don't think you can say a company gave up on a game based on them not making a feature that was never promised, just because you think it would be great. I agree that Mythic has given up and also agree that a third faction might make the game better, but combined they don't prove mythic has given up unless they are not meeting their promises.
I said they had given up on the game because it is in pretty bad shape and they dont seem to do pretty much anything about it beside some minor tweaks here and there.
Tweaks are nice but it wont bring any people back, an overhaul and major content may. Also it is not just me who think a third faction would change alot, it has been said ever since beta that a two faction RvR is doomed to be imbalanced.

If they either close WAR or don't, at least, fix it MMO players will frown at them and it could have some seriously bad impact on the first sales of their next MMO: TOR.
They have much more to gain by keeping the game alive than killing it.
