Slovakia is the country I researched on quite awhile ago when this issue came up. I had 2 very informant links about the laws, in both Slovakia and Interpol. Not only does Slovakia have its own branch for dealing with software infringement/emulators/bootlegs and all that good stuff, but its a member of Interpol, which of course has hard crackdowns on the subject matter. You arent only dealing with Slovakian laws, you are dealing with Interpol as well, which means quite frankly you are fucked.

But if for some reason (and in case of SWG that is a significant issue) people would prefer an emu over legal version, then the numbers could not only increase beyond that, but would affect the subscriptions as well.

But the main (and most likely only) legal issue is the copyrights over art. The source code itself and EULA aren't that important, Most of the software legalities are hard to enforce, copyrights on the other hand get handled daily.

And that isn't even a slam dunk case. We paid for the game that we bought when we bought it, which is a license to the copyrighted material. That didn't stop the UO emulated servers.
I doubt they will sue, but instead will throw up some classic servers instead. As you said earlier, if they did that demand for the emu servers dies instantly.
The only way the EULA applies to you is if you are an active SWG subscriber. Once the emu comes out and there are solid, stable servers with solid player bases, I don't think I will be a SWG subscriber anymore...

I know SoE is bad, I don't know who the others are or how their cooking is, but I'll give them a chance.
Time will say, I will hope they succeed and give SoE a good lesson. If not, well, shit happends. Until then I'll give hope to the people I know would like to come back for a Pre-cu server.
I think that if the Emu is solid and runs well on reasonable hardware, SOE and everyone may be quite shocked at the playerbase and intrest it attracts...

From what I have seen they only have the client side info so they have the planets... the landscape. All mobs and items are server side from what I understand and unless they have a copy of the server side script then they dont have much more then wet dreams.
I will say this though, if they do happen to create or set up these servers then they will make more potential to make money then SOE and LAE does simply by giving the customers what they want. If they get it working and large numbers decide to flock to them, maybe Lucas will take Torres' head out of Smedley's ass long enough to tell him to make classic servers (though I doubt it would happen even then).

Seriously. If they, under any pretense or justification, through any and all means, obtain a single dime, they go to jail, with trial over in record time. It's called copyright infringement in the most basic sense. That includes receiving money for server upkeep, hosting, domain registration, random donations, cash in an envelope, through wireless transfer, via credit card, in form of material good, or via other means that could be considered as "for profit". It's enough for them to put up an ad on their page, for all of this to be effective.

I know this isn't exactly what you meant, but mentioning money in connection with any such activity is really bad. Unless you have a good lawyer on your side. And even then, you'd still be going up against LEC.
As for server data, there is enough. Once you set up the back-end, apart from a few static spawns, everything is rather trivial to auto-generate.

However they can shut that server down. no need to go after all the individual players. I myself wouldn't play an EMU simply because of the legal ambiguity, leaning towards illegal.

Yup I think it would be illegal to play, as the client has to be modified slightly to reach the new (emulated) servers, but well, good luck finding each player using it...
The emulator can probably be done without using any kind of intellectual property (this is after all inside the client software) and in this case they would have no proof against it.

Why is there an EQ emu still available then, with ongoing development?
The breaking point is the functionality. As long as there's a single emulator, hosting 200 people nobody will do anything. It's not worth it.
But if for some reason (and in case of SWG that is a significant issue) people would prefer an emu over legal version, then the numbers could not only increase beyond that, but would affect the subscriptions as well.
And this is where you have a problem.
But the main (and most likely only) legal issue is the copyrights over art. The source code itself and EULA aren't that important, Most of the software legalities are hard to enforce, copyrights on the other hand get handled daily.
A server unfortunately cannot be developed without using a small part of this (it can be done without modifying the client though).
The EULA is a joke and doesn't even pertain to any of this argument. It is the code of conduct to play the game ON THEIR SERVERS and isn't at all binding anywhere else. If you're not on their server, it has no teeth.
It's the copyright issues that they'll be enforcing in court. That's the hammer that will fall.

I doubt they will sue, but instead will throw up some classic servers instead. As you said earlier, if they did that demand for the emu servers dies instantly.
The only way the EULA applies to you is if you are an active SWG subscriber. Once the emu comes out and there are solid, stable servers with solid player bases, I don't think I will be a SWG subscriber anymore...

I won't give links, you can find them at google easily, there are still some servers with EQ1 running out there.

I know SoE is bad, I don't know who the others are or how their cooking is, but I'll give them a chance.
Time will say, I will hope they succeed and give SoE a good lesson. If not, well, shit happends. Until then I'll give hope to the people I know would like to come back for a Pre-cu server.

This all seems to be a big hoax at this point.
From what I have seen they only have the client side info so they have the planets... the landscape. All mobs and items are server side from what I understand and unless they have a copy of the server side script then they dont have much more then wet dreams.
I will say this though, if they do happen to create or set up these servers then they will make more potential to make money then SOE and LAE does simply by giving the customers what they want. If they get it working and large numbers decide to flock to them, maybe Lucas will take Torres' head out of Smedley's ass long enough to tell him to make classic servers (though I doubt it would happen even then).

Seriously. If they, under any pretense or justification, through any and all means, obtain a single dime, they go to jail, with trial over in record time. It's called copyright infringement in the most basic sense. That includes receiving money for server upkeep, hosting, domain registration, random donations, cash in an envelope, through wireless transfer, via credit card, in form of material good, or via other means that could be considered as "for profit". It's enough for them to put up an ad on their page, for all of this to be effective.
An eDonkey page was providing links for over two years. Nobody and nothing could tough them. They put up an advertisment, and went down and to courts in under a month.
Never joke about it or mention receiving money. It's that serious.
I know this isn't exactly what you meant, but mentioning money in connection with any such activity is really bad. Unless you have a good lawyer on your side. And even then, you'd still be going up against LEC.
As for server data, there is enough. Once you set up the back-end, apart from a few static spawns, everything is rather trivial to auto-generate.

I am just saying that a lot of people commits serious crimes and are never caught, why should this be different? SoE will not waste money chasing each player using an emulated server.
And in the case of the emulator, yes it is fair to make it.
Each player who left swg had a reason... Or many.. Just to say one (of many), I spent about 500 hours playing to reach jedi because nobody told me it'd be completelly useless one month later. I think I deserve something in exchange (like being able to play pre-cu servers)

However they can shut that server down. no need to go after all the individual players. I myself wouldn't play an EMU simply because of the legal ambiguity, leaning towards illegal.
