With reasons like that, it's not likely you'll be able to get a refund.
-They never claimed that the game would have servers for NA only players. North American server is located in NA, just like they said it would, and Australian players are playing on that server, just like they said.
-Bugs are more or less a part of any game. As long as they don't make it unplayable for you you don't normally get a refund just because of some bugs that will likely get fixed with time anyway
When was the last time you played an mmo? those % are clearly innacurate but i know what you mean. I find that same thing in every mmo i play. Every single one of them, including AAA subscription based ones which were "supposed" to be the ones filled with adult gamers that behave like adults. Thats not a reason for me personally to ask for a refund. Just ignore the trolls and interact with the rest. But you stated other reasons why you are getting a refund so some of those make more sense.
Lol.To be honest I only saw one bug. But I relogged and the npc was thetr xD. You dont only got ppl from Aus. Also from the EU, some. Maybr the lagg is ftom something else? Anyways km enjoying the game!
The ingame community seemed pretty good, although I'm on the EU server, I admit. You can hardly claim a refund on the basis that you don't like the community based on what you saw on the first day of early release! I had ZERO bugged quests, which was a nice surprise, and haven't heard of any character creation bugs (as yet).
As for lag when playing in Australia, well, it has ever been thus and it wouldn't come as a surprise to anyone after all these years of similar lag, so I don't think you'll get a refund on that basis. Not when that's your biggest gripe.
I didn't like FFXIV a realm reborn and stopped subbing after 2 moths.
so don't sub.and investigate better as to get something you like,i dont know where you will get servers that soot just you.
the more popular the game, the worse the community will be.
at least being sub based it keeps many of the trolls locked away.
oh and the very first thing i did after i created my character was turn off zone chat.

Umm, an Australian players connection has ZERO affect on your connection to the server.
Just because people outside NA are playing on it (And it was clearly said that the choice of server was the players choice, so Europeans can play on NA and NA can play on the EU server) it doesn't affect your connection in any way.
Also you want a refund because some players are immature? There's an ignore function.
I am not even sure what you wanted/expected, you are NEVER going to find an mmo without some idiots in it, it's IMPOSSIBLE for a company to somehow "police" their servers in terms of maturity.
Yea i do that too, did that in SWTOR too.... sad but true. We do have a big guild tho so i always have people to talk to...
indeed, sucks to be him. OP might want to just quit mmo's all together.
i too wish communities were good again, i just don't expect it out of a brand new popular game like ESO.
my suggestion to the OP is to find a good guild that he likes, leave zone chat and only group with your guild or cool people you meet in game.
zone chat makes it seem worse than it is, just shut it off.

OOhh, right - that slipped by me. I doubt that HE would have problems with players from Australia being in the game at the same time he is. If he is, it would be the first time I have heard of that in well over a decade of playing mmorpgs.
If you knew you shouldnt buy it, why did you went through with it? Your fault for not trusting your judgement.For me, I have great time with two of my nephews. Server lag? What lag? I am connecting from SEA, with the usual latency.
Did you simply miss all of the zillion beta tests they had? The only fault here is your own.
You DO realise an aussie could be playing with grandfathers old dialup and only person he'd cause any lag to is himself?
The basics on how internet works is high school level stuffs.
