Im in the beta from allods atm and it feels a bit like the vanilla wow times. But much better cuz they force you to pvp after lvl 22. Questing areas are for both factions with one small neutral camp where the npc's at. You get pvp missions, gear for your pvp rank... Hope the factions are still balanced at release.
Another thing is the beta lvl cap is 30. So we dont have acces to the astral ships and this type of pvp. I can recommend Allods for everyone whos not a wow hater. Best f2p mmo choice! =D

Player made cities that are conquerable/siegeable. Siege equipment. FFA full loot pvp. One of the largest non-instanced gaming worlds. Player made boats of varying sizes, speed and offensive capabilities that are fully destructible. Mount combat.
Large scale battles. Collision detection. Darkfall has it all.

as to the OP not sure i haven't played many OPEN world pvp games, i've played a bunch of pvp games but not many OPEN world pvp. guess my only experience with open world pvp was AoC but i don't think it would be considered the best. pretty sure you could pvp in the towns but guards policing the city would try to kill you if they saw it. but still open world i guess.

The only place you can't willingly attack lower level players is in their starter areas which is what, 10% of the open world? Other than that, you can attack anyone, anytime, anywhere. but when they added arena they killed any player deemmed of the name from ever staying in openworld to pvp without reward
when they can go in any place instanced and get reawrd to pvp.

Exactly. World PvP in WoW is pointless. You lose nothing and it changes nothing, you just spend time walking back to corpse and the annoyance of being unable to kill mobs in that area and maybe consumables. Wintersgrasp was the closest thing to a meaningful World PvP but then it couldn't handle the "open world" of PvP and got instanced and pop. capped. In the past there was Silitius/Plaguelands objectives that brought World PvP in, and I'm pretty sure there's something like that in Outlands for TBC, but it's all obsolete now.

Both Eve and Darkfall have protected areas for noobs. Darkfall uses archers. Eve has a training zone.
What makes WoW's pvp king is a responsive combat system, you press a key to fire off you're instant spell and it happens instantly, not two seconds later.
WoW's combat is involved with many counter measures. Know how to pvp in WoW means know how to pvp against each class and each of the three class branches. People practice in WoW to get better. They practice by dueling.
Getting back to the OP's question. Since WoW and WAR are heavily instanced and lean towards PvE centric mostly, they dont make the cut in my book. But some that transcend the adolescent and cheap design of drawing community together through PvP in its broadest competetive sense, aside from the myopic view that its just combat are (and not necessarily in this order):
