Does it suck that they banned you? yes.  Does it really matter? no.  You did not pay for anything, they gave you a free trial and decided to end it sooner than expected.  I am not even going to get into the fact that you probably told one of your friends about the game and they ratted you out for breaking the NDA.

I believe im not the only one thinking this but, chalk this one up as another reason to not beta test a game that you plan to play at release.

You think that one of my friends went and told Bioware, come on that is grasping at straws. I mean seriously.

And second of all they said very clearly in the email, you were banned for discussing illegal activity. Okay but their own tester agreement says nothing about discussing illegal activity. Does that make sense? Yeah it was only a 2 day beta fine, but seriously why ban me and says for discussing illegal activity if they were done with me. Just say oh we have decided you do not meet our ideal requirments for a game tester, and leave it at that. Why make up some phanton clause in a tester agreement.

As has been pointed out; they can ban you for breathing if they want. They are under no contractual agreement that forbids them from doing that.

Moral of the story? Act like a fool, and get banned. I just gained a bit more respect for BioWare.

Yeah good one. I didn't talk about illegal activity in and around the game. I wasn't exploiting, Yeah they can ban you for breathing sure, that makes sense, but why make up this phanton discussing illegal activity clause.

no one knows what the hell to say to you guy. 2 days of beta shouldn't really be taking up so much space in your brain you cant remember what you did wrong.

No sir I never posted anything in the general forum, anything I posted was in my beta squads locked forum. And nothing I said on there was anything more than the usual happy to be playing stuff.

we are clearly not getting through... So in the future save us the time and just DON'T join a beta. I am going to state this as clearly as i can. You (as in DarthYoyo)did type something in-game that they(as in Bioware) considerd to be against the rules of the NDA you signed when accepting the invite. The fact that you do not know what you said is irrelevant and if you sit tight for a week or two i am sure someone(as in a community rep from Bioware) will get back to you with a answer. Untill then enjoy your other daily activities.

Edit: Found this in the first line of the ToS

It violates BioWare's Terms of Service if you (or others using your Account) engage in any of the following behavior:

Post, transmit, promote, or distribute Content that is illegal.

So honestly... it is enough to talk about that TV-series that you downloaded from the net...

This have been a good conversation

You keep going on an on about illegal activities. They banned you for

"Reason for Suspension: Game Testing Agreement Violation"

    then it tells you why:

"This account has been indefinitely suspended for discussing illegal activities which is in direct violation of the Star Wars: The Old Republic Terms of Service and Game Testing Agreement. Details of both are located at".

They are telling you you talked about shit you shouldnt have, and because you screwed up and broke the  "Dont be a moron, report shyte to us, dont talk about it" section of the agreement.

They didnt ban you for some thing illegal you did in game or on forums meatball. They stated your banned for talking, ie: "DISCUSSING ACTIVITIES"!

The following is from the Rules of Conduct which forms part of the Terms of Service:

It violates BioWare's Terms of Service if you (or others using your Account) engage in any of the following behavior:

Promote or encourage any illegal activity including hacking, cracking or distribution of counterfeit software.

This is from the Terms of Service:

BioWare may also terminate your Account(s) (and access to all related entitlements) for violation of this Terms of Service, breaking the Rules of Conduct, illegal or improper use of your Account, or illegal or improper use of TOR Services, products, BioWare's or LucasArts Intellectual Property. BioWare may issue you a warning, or BioWare may immediately terminate any and all Accounts that you have established.

If that's what they're going with then that's what they're going with. Not much anyone here can do about it.

Post, transmit, promote, or distribute Content that is illegal.

MMORPG.com's says almost the same thing.

    Illegal Activities

    • Either committing or the discussion of committing illegal activities at MMORPG.com will not be tolerated. Illegal activities include, but are not limited to: illegal drugs, fraud, violence, hacking, software piracy and sexual harassment. As appropriate, illegal activities will be reported to the relevant law enforcement agency.

Okay I understand, yes I am innocent but I don't expect you to believe me I guess. So let's look at it another way. Let's say that I discussed some illegal behaviors(which I didnt). So lets say that is true at the same time, The terms of service and game testing agreements dont say anything about discussing illegal activity...

I've gone over both and failed to see anything that would even be similiar to discussing illegal acitivity.

    Here's the email I got

We are contacting to notify you that your account for Star Wars™: The Old Republic™ has been indefinitely suspended.

Reason for Suspension: Game Testing Agreement Violation

This account has been indefinitely suspended for discussing illegal activities which is in direct violation of the Star Wars: The Old Republic Terms of Service and Game Testing Agreement. Details of both are located at:

If you disagree with the outcome of our investigation, please reply with all relevant information.

    Regards,

Sounds like a perma ban.  Wouldn't be surprised if that was active after release also.  They have transcripts so I'm sure they have the records and have looked at them.

I did not discuss bugs outside of the proper channels.

I did not say anything in game, outside of game, around game, that would have violated any agreement.

I was just banned out of the blue. One second playing next second not.

Yeah okay, you guys respect Bioware for banning someone "like me," thats fine, you  think that I'm one of those exploiting cheeseing, guys you hate that can't follow instructions.

I dont know no one has found the part that says "discussing illegal activity in any agreement.

Bioware hasn't sent me any evidence against me. Yeah it was free, I didn't have to pay I shouldn't be as upset as I am. But I dont like seeing this when I got to log in

You have been banned for the following reason:

STAR WARS: The Old Republic -- Account Suspension Notification -- Game Testing Agreement Violation. Check email for more information or contact bwacommunitysupport@bioware.com

Date the ban will be lifted: Never

How would you feel if you saw that randomly?

  • FlynniganFlynnigan Member Posts: 54

He doesn't understand apparently. They've worded it so everyone else has understood and laughed, and he sits there like my kid when he gets caught doing something wrong:

    "What did you just do?"

    "Ummmm, I dont know?...."

I wouldn't be real happy. Then I'd move on to the next game.

It's a game. Actually it isn't even that yet.

You didn't read my first posts. I didn't do it. Okay. But EVEN if I did discuss illegal activities all over the place, there is nowhere in the tester agreement that says anything about that..

That was my point, I not only got banned, but banned for a phanton clause.

    Exactly.

@OP: you didn't get banned for a "phantom clause", you just didn't bother to pay much attention when you reviewed the RoC, assuming you even did.

Seems like a completely justified ban to me, they caught you discussing a subject that was not appropriate, and as such you were repremanded for your actions.

My last post in this farce is:

Read the Confidentiality statement in your tester agreement.

If your still confused and blindly claiming your wronged, re-read it, re-read it some more, then re-read the statement of them telling you you can be banned for w/e reason they find.

IF you seriously still dont get it, find another adult to read it to you in person and explain it, chances are they will understand.....
