You were paying for DnL not SoG. That little disclaimer would not be worth the pixels it is printed on. Considering that credit card companies are kissing peoples feet these days to get their business, that would be all that would be needed to get the charge blocked. A 10 minute at most 1-800 phone call.

aha thats funny. I know a guy who is the VP of a ISP company. They have around 40,000 subscribers. They were constantly getting guys doing charge backs from a certain country even though they had 100% proof the people paid for the service and requested it. They still had to pay back all the $. So they blocked the countires IP now.
Point is.. the customer is ALWAYS right in these cases.

They don't need "legal windows". If NPCube claims that the pre-order is not refundable does not make it true if the law states that a refund is in order on certain cases. For instance, inability to deliver the product or the product not containing all the advertised features are both valid reasons to request a refund, even if the company claims that the product is not refundable.
