Is it possible to take SOE and LUCAS ARTS to tribunals?


Charges:

 

Swindle:

n. to cheat through trick, device, false statements or other fraudulent methods with the intent to acquire money or property from another to which the swindler is not entitled. Swindling is a crime as one form of theft.

 

Intrinsic fraud:
n. an intentionally false representation (lie) which is part of the fraud and can be considered in determining general and punitive damages. This is distinguished from extrinsic fraud (collateral fraud) which was a deceptive means to keeping one from enforcing his/her legal rights.


 Fraud:
n. the intentional use of deceit, a trick or some dishonest means to deprive another of his/her/its money, property or a legal right. A party who has lost something due to fraud is entitled to file a lawsuit for damages against the party acting fraudulently, and the damages may include punitive damages as a punishment or public example due to the malicious nature of the fraud. Quite often there are several persons involved in a scheme to commit fraud and each and all may be liable for the total damages. Inherent in fraud is an unjust advantage over another which injures that person or entity. It includes failing to point out a known mistake in a contract or other writing (such as a deed), or not revealing a fact which he/she has a duty to communicate, such as a survey which shows there are only 10 acres of land being purchased and not 20 as originally understood. Constructive fraud can be proved by a showing of breach of legal duty (like using the trust funds held for another in an investment in one's own business) without direct proof of fraud or fraudulent intent. However, increasingly fraud, which has victimized a large segment of the public (even in individually small amounts), has become the target of consumer fraud divisions in the offices of district attorneys and attorneys general.

The game we buyed isn't NGE.

We dont have any change to play the game we buyed.

    I think, it's the same that you buy WOW, and after you installed it and begin to play, you see that you are playing Guild Wars.

    Fraud? Swindle? or what?

    Sadly, SOE/LA have the funds and the legal team to disprove this, and in fact make it seem like they're doing you a favour and you should be grateful.

    I would think that it would depend upon the individual.  If you happened to buy the game after they started working on the nge (which you would have to prove when they actually started working on it), you may actually have a decent case.

    Yep, they have "one" team to grind in tribunals, ok, if all of us take SOE to tribunals, every one of us, they must win all the cases in all the tribunals, perhaps too expensive?

    Perhaps is less expensive to open servers with pre-cu, or to win all the cases in tribunals?

    I can't imagine that the CUNGE didn't violate consumer protection and fraud laws in at least one country, state, or locality where SOE does business (ie, where the subscriber lived).

    In my "Adventure Manual" the one that comes with the game, says that there are Elite Professions, fencer, pikeman, rifleman, etc..., and  Hybrid Professions pag 73-75

    Where are these professions when you play the game?

    I know that the "game experience" may change, but the game itself...

    The game they sell today does not have the same manual , I have all 3 . The original , the total experience and the starter kit .

    Personally I would be more impressed if someone actually made an effort to take this to the courts instead of anothe rlame "I think we should" thread. Do it or don't but lets stop talking about it over and over again.

    If you do go to the courts how will you prove that they went above their statement of "This game may change during play" statement?

    It'd be much better for a New York state attorney general to hear from a citizen of New York than a citizen of Kentucky, wouldn't it?

    I wouldn't be impressed.  I would be horrified.  Seriously this is exactly why tort reform is needed in America. No offense but anyone who would sue over SOE changing the game looking for some sort of compensation is a complete jerk off.  I too enjoyed pre-cu.  I played it loyally since release date.  They made a developmental decision. Pre-paid accounts have a series of steps that could be taken to address the issue they may have had without resorting to suing.  I am serious about hating the idea of suing people over such things as a change in the core game mechanics in an effort to improve the game.  No offense but I dont think anyone suing has a leg to stand on in court.

    I dont want some compensation, I want to play the game I buyed. Star Wars Galaxies, not Star Wars Galaxies NGE.

    SoE suxs and u know it... SWG was just a beta ... sadly there is no way to make them pay for what they done....  The solution is easy for all those who like SWG the most  b4 CU ... bring  1 or 2 servers with the original game.

    Anyways that wont happen , they never gona accept the big mistake SWG was from the very start. I would like to see a server runing PRE-CU SWG but... wont happen..

    So .. Garva and all the SoE team can suck my right testicle.

    U guys made an error and dosnt have the balls to accept it and tell it to ur community. I have a last word for them.... Take a gun  , and use it urself... the world will be much better without incompenents like u guys.

    No it wouldn't. Law is the law regardless of where you lived. And lawyers don't care where you live as long as your checks do not bounce.

    Me either. Thats why I say I would be more impressed if these people who bitch and moan EVERY day actually did SOMETHING about it. Not that they would win but at least we wouldnt have to see these rediculas discussions on these boards.

    Let's say that 1.000 people x server left the game because of NGE, "a great improve yes". And we know, that were more people that left the game.

    From 25 servers, so 25.000 people. OK, not so much, but if all of them sue SOE, SOE must win 25.000 cases at tribunals. We only need to win one.

    I have an idea eldakar , first go and buy a shirt with the words NGE and SWORDSMAN LOVE. Then buy a katana , after that go and kill some random peeps u find on the street , after that blame SoE because they made u go crazy because of theyr game , and here we go... we can win....

    While reading my manaul i found this.

    "Like many massively multiplayer onlne games, Star Wars Galaxies is a deep and ever-changing experience. As the game grows over time, new CONTENT, SYSTEMS, and GAME MECHANICS will be added. We have tried to ensure that the Adventrue manual is up to date, but given the evolving nature of online games, there is no way to ensure that it remains completely accuarate or inlcuded information about every system in the game.

    Sad but true :(
