Instanced PvP is the best solution in my opinion, for themepark games.
For sandbox games it's terrible of course, and you want open world pvp, BUT with added incentive (full loot i.e.)

sorry, but games need constant maintenance and work, especially a sandbox mmorpg the size of darkfall.
monthly fee is very fair for this - its only 15 euro's! who can't afford this per month. you'll easily spend at least 60 hours in it per month.
