Aventurine NDA

nileqnileq Member Posts: 476

Apparently the NDA must be signed and returned to Aventurine before you will be allowed into the Beta. I wander how many fax-machines they have running, since they sent out 1000 invites this week ;-).

And if you wander how I know that it must be signed and returned. The NDA is on the internetz.. (cant link it for obvious reasons..)

Also on a side note, the first person that leaked the dragon-SS's has supposedly been banned and AV is pressing charges.. ouch.. That might explain the few leaks

hmm, maybe thats the point with the NDA....to not talk about it?

But seriously, even the professional beta leakers havent seen anything like this for eight years. There are leaks, but nothing as any other MMO. Almost nothing. I have seen screens of charcter creation, login screen and som UI. Thats it.

The NDA for DF could be harsher, it could also offer more incentive like getting DF for free, having a life long membership, or something else special in game

    Look someone made a funny.

Give me that NDA to sign.  I'll sign it and mail it back then post tons of videos and screenshots everywhere on some Russian proxy.

Then laugh at Aventurine while they try to press charges.

You cannot press charges for breaking a fucking video game NDA that says "don't talk about our game" and if they are actually really trying to do that they are wasting their time and are pretty pathetic.

hey, have a search around and you will find the NDA, and it is VERY strict.

Also it is a binding contract, why would they NOT be able to press charges if you violate it? I'm not saying they will win, but just pressing charges will make the point come across wouldn't it?

They can. But who the fuck would actually SHOW UP to court??  Get real.  Nothing can happen to you. You can't go to jail for breaking a NDA.

On top of that they would first have to find you to even serve you papers.  It's a joke.

All this talk of NDA and other indications coming from Aventurine give me at least the feeling that this release is going to be another Funcom. If it turns out to be the mmo will not last very long. I for one will be waiting for a few weeks after release to see what others have to say about this game.

    I just read the NDA.

The funny thing is how do they know that who is signing it is actually the real person?  You can easily just sign any made up name on it.

Do they ask for birth certificates and copy of your license too?

A Darkfall NDA suggests that Aventurine actually have an MMO in development, then they'd have to prove it in court in order to sue the NDA breaker. Since they can't release info and advertise two weeks before the (alleged) release, how are they going to get thier shit together for a court date?

Unless of course the judge is a Darkfall fanbois and just accepts whatever comes out Tasos' mouth as the gospel truth without need for evidence, and brands the defendant as a hater because he doesn't agree.

It's harch I grant you that but it's not a joke if they drag you to to court.

And ofcourse you won't go to jail, but you could be slapped with a fine.

I think you would think twice too, your e-peen don't give you any freebees in RL

Edit: If you would be a no-show in court (in civilized countries that is) the court would likely rule against you and you would be MADE to pay the fine. You DONT play hide and seek with the justice system.

    What banana-republic are you from?

The point he's making is, if all they have is a signature on a piece of paper and no other form of ID or an address they don't actually know who they're supposed to be taking to court. How do they serve papers to this person? How do they identify him/her?

I give a false signature and no other ID where will the police go to pick me up? For a small civil case the police aren't going to pick me up and drag me to court in the EU or anywhere else on the planet. I don't turn up the judge will go in the favour of the prosecutor, but since they don't know who the hell I am it doen't really matter.

How will they get compensation when all they have is an email address and a signature that reads "Ivor Biggun"?

I dont care about Europe. That's another reason why their NDA is a joke. Because they would have to go after people internationally to try and enforce it.

funny thing is if they wasnt even trusted enough to recieve a beta invite they wouldnt even think about putting fake info. fake info is if you plan on leaking in the first place

Because you are required to add Name, address, country on the actual NDA. Look it up.

And as I said in my other post, you don't need to show up at court, they will rule anyway. (and probably against you if you are a no-show.)

Do you know anything about international patent laws? Do you know you can be fined internationally?

But thats not the points I was trying to get across. They could easily have other penalities that would prevent people from breaking an NDA other than court orders

UBI Soft tried to sue PKER.org years ago for posting NDA stuff from Shadowbane.

They laughed at them. And nothing ever happened.

I am telling you NDA's are a joke.

Again, your participation in the proceedings is not required in most civilised countries..

So unless you are from a banana-republic it don't matter. And will only look bad for your case.
