They wouldn't be able to drag me to court because I simply wouldn't show up. They would be sitting there like morons themselves.

Again, your participation in the proceedings is not required in most civilised countries..

So unless you are from a banana-republic it don't matter. And will only look bad for your case.

    Who cares?

They can fine me. I won't pay. They would never get their money.

Don't you get it?? It's a joke unless you're able to go to prison.

PKER.org hardly signed an NDA so the joke is on you.

You seem to think that your e-peen is pretty large, I am willing to bet that you would cry in RL when the law-suit found it's way to your hands.

Not paying count fines is like not paying your mortgage and can negatively affect your credit score. So its not a joke.

It seems odd that Aventurine has all the time and resources to hunt down a single NDA breaker, yet not enough to update thier website 2 weeks before launch. Don't you think?

Also the downside of taking an alledged NDA breaker to court is you get bad PR, also even if you prove it what would Aventurine get in damages? Since NDA breakers usually create hype for a game and increase interest I would find it interesting to see what Aventurine would be "rewarded".

However this story about taking NDA breakers to court sounds as fishy as a seven pound note. Sounds to me like fanbois and or Tasos making up stories to explain why there are only 2 crappy vids on the web after close to 10 years of production and atleast 3 closed betas over 5 years that I can remember. Just a cover story for the vapourware boys from Greece!

"Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience"

That don't even come close to AV's NDA. Look it up and read it and you will see.

And about you not paying fines, that is all fine and dandy, some people take their lives a bit more seriously than you do I guess.  You probably wont be playing DFO since I doubt they have broadband in the trailer park.

I too find it quite unlikely that AV is actually sueing someone, but the rumor might be quite effective against the current beta-testers and that might be why they don't deny it.

They might not be able to link an uploaders identity to you, as an under NDA beta tester, but don't forget they might be able to deduct the exact position from where a screenshot was taken, or where a movie was made and find matches in their logs to easily find the culprit. Even then they might have to prove that is was actually you that uploaded the material somewhere, and not your evil sister, or whatever, the source client wouldn't be so hard to determine and they can easily ban you for that.

    funny thing ids the nda

    covers

some of this stuff people are saying heh

I seriously doubt a court is going to waste much time pursuing a random gamer that posted some screenshots in violation of an NDA, regardless of what silly stuff Aventurine puts into it.  Especially if the NDA breaker is outside of the EU. Also, if said gamer used a chinese site to upload...it would never go farther than that.  China gives a rats ass about copyright, piracy, etc and so on.

Hell, countries have trouble getting people imported to face murder charges and what not.  You think they will expend much effort to chase down a video game NDA breaker? Get real.

Although, I must say it seems like it would hold more water than a flimsy EULA that the company can change at a moments notice.  I see EULA's being even more meaningless than they are now in the future.

On another note..if a beta tester were retarded enough to fill out any actual valid information on that NDA, and then leak...he/she deserves whatever they get.

Well, you will need to sign an affidavit with legit information, then confirm it with a notary.

  • rideyarideya Member Posts: 39

First off, you CAN go to jail for failure to pay court fines (Law 101 people. If that were the case, NO ONE would pay fines)

Second, if you EVER plan on owning a house, or a car, you better damn well worry about your credit score.

Now I understand this, how many companys have sued NDA breakers in the past? None. It seems that Aventurine is going to pave the way in the MMORPG industry and become "next Gen" by doing something never done before. They're going to sue an NDA breaker! Yes another amazing feature to add to the long list of impossibilities included in Darkfall.

The game is a turd but this is a forwarding thinking company, ready to do go where no MMO company has gone before!

(play original star trek series tune)

And if you wander how I know that it must be signed and returned. The NDA is on the internetz.. (cant link it for obvious reasons..)
Also on a side note, the first person that leaked the dragon-SS's has supposedly been banned and AV is pressing charges.. ouch.. That might explain the few leaks

    The REAL question is:

WHY is the NDA still in place... with less than 2 weeks to Release?

Still waiting of an example of another good MMO that kept their NDA in place for as long.

If the game is  Ready... why is the NDA still in place?

Do they ask for birth certificates and copy of your license too?

    that isnt the point

    Nope... the point is:

Why does DarkFall still have their NDA in place with less than 2 weeks until Release?

    THAT is the point.

    Heh... good excuse.

IF the game is ready... the NDA would be lifted.

    It's really that simple.
