These are the facts....mostly anyway. You can continue to ignore or dispute them as much as you want, but you have already lost. It might be shady, but so is what the Columbia Record Club does or did...I have no idea if they're still around. And SV was FAR more clear about the no refunds policy.
You seem to fail to grasp the concept that you are wrong, more than once in fact. There is a WHOLE big crowd of people out there just like me who saw that 'no refunds' snippet and steered clear. Oh, and Aion had a no refund policy from the official website too. And DF had one too. And I'm pretty sure FE had one too, though I could be wrong. In conjunction with a box purchase of MO you were given a digital copy as well. Since you probably applied the key you were given you 'opened' it.
Digital download sites like D2D and steam have a no refund policy too. Once you buy the software you see the key for it which means you could just get a refund and get a pirated copy and use the key for it.
This isn't the same with a purchase like this, but there are other impacting factors having to do with accounting. More and more pre-orders for physical copies of games are being done like this.

Yep food industry has a no refund policy. The problem is if I bite into my taco and find something that isn't supposed to be there, an undercooked product or find it to be spoiled that no fefund policy goes out the window.
Yeah, apparently you can't force someone to pay for something that wasn't cooked properly... but hey I am assuming you were hoping this wasn't pointed out.
You can not enforce a no refund policy on a product that does not work.
You can not enforce a no refund policy for a product that the consumer may one day see. It must be shipped when you stated it would or in a reasonable time frame after. If it isn't going to ship when you stated it would it's your responsibility to try and smooth things over with your consumer with discounts or other forms of compensation and ultimately give them a refund if that is what they desire. "Someday" is not what was agreed to and is not a time frame SV can legaly use to keep the money from the pre-orders.

Bottom line is regardless of how you, I, SV, or anyone else feels. SV broke the agreement and there fore there consumers are no longer bound by it. That no refund policy went out the window completely as soon as they did. In any event it's not like that no refund policy held water prior to recieving the product anyways. Until it's shipped, it's not a completed transaction. You can change your mind prior to shipping.

Now, to me.. getting a boxed copy of the game kind of signifies that the game is pretty much shipping at that point. Sure there might be a big patch or two, but if I am getting the boxed game in Sept I kind of expect to be playing the game shortly thereafter. Well... it's now going on January and I haven't received ANYTHING from the company except heartache. They have a NO REFUND policy. So even though they took my money and said I would have something in September and haven't delivered jack as of today, they won't refund a cent. What kind of company does this? To make matters worse the entire company is supposedly out on vacation for 2 weeks so I can't even get an official response! Posting official questions on their forum only result in "true-believers" responding with drivel like "The game isn't done yet. Why do you want a cardboard box and disc?' Is it too much to ask a company to refund money they took 6 months ago for a game they haven't delivered yet? They haven't even shipped a product, are 4 months late from the estimate I was given when they took my cash, yet refuse to even answer requests for refunds? There was a strict NDA up at the time of purchase so I had NO idea the game had no chance of shipping in September. I stupidly took their word that they really planned to ship in September. I understand that delays happen, but there is NO WAY they legitimately thought their product would ship in September when they took my money in mid July. Buyer BEWARE! If you really want to give your money to such a company on blind faith, go right ahead. I would urge you to reconsider and save yourself a lot of heartache.

I wasn't aware of ALL THE ISSUES AND PROBLEMS with this Dark&Light/Darkfall scam artists.. I learned my lesson though. Never ever trust amateur companies who promise you the kitchen sink in their MMO's.. It's ok to keep an eye on the progress first, then in a month or so If the game appeals to more than half the population, then go ahead and take a chance on it. But I'll never buy any more products blindly again,, especially products not even close to being ready for release.

That's basically the only thing people paid for. Now that we see beta sucks and we want our physical products shipped -- there are no responses, emails, updates from SV other than maybe a month ago, where they say "Sorry".

Fact of the matter is, for me anyway....we probably all need to STOP paying for betas. The developers will keep doing it as long as we're willing to pay.
So the lesson here is:
We gamers (I really just speak for myself here, but bear me out), could probably use to learn a little patience. We all get excited when a new game is on the horizon and we want to help in beta, or some of us, just want in beta to have a preview of what's to come. I know for myself....I'm just not going to be paying to "beta test" any more. I've done it twice now. Both times were nightmares, and probably because my motivation was to have a sneak peak into something that I already felt SURE I was going to love, so why not pay for it ahead of time and get to help out some in the process?
I think time has taught us (or at least me) that beta testing should be for working on bugs. Either they pay us to do that, or we do it for free because we want to help. Under no circumstances is CHARGING for beta a good sign. At the VERY least...it is a misnomer and what you're paying for is actually a game that is unfinished and the developers are, essentially, BORROWING your money. I am not a BANK, and I no longer intend to be in the business of loans, regardless of whether they are 50 or 100 dollars. Of course, this is just my take on it, and my own lesson learned.
Alright, since you seem so stuck on this whole September release deal being stated in July I've taken the time to prove you wrong. This is from the second newsletter in July and the only one that talks about release dates.

The Beta is divided into Blocks of 2.000 players each, depending on buying-order. Every second week 2.000 additional players will be able to enter the Beta. The full schedule is as follows:
July 20 Block A (including 999 Limited Editions)
August 3 Block B
August 17 Block C

The Digital Download only version will go on sale a week later than the Boxed Version and The Full Loot Bag as previously stated in the shop. This is because we hope to sell the physical products first, as they are a big cost to us if they sit on our shelves.
Shipping is included in the price for the physical products.
The physical products will be shipped from Sweden around September. Further updates before the launch of the full game will be shipped free of charge in connection to the launch. When buying a physical version you are also allowed to download the game, and play it in your corresponding Beta block.
The launch of Mortal Online is planned for Q4 2009 (Oct-Dec).This is not set in stone however, as we want all core features to be in place and properly tested before charging monthly subscriptions. We do not guarantee a specific release date for Mortal Online.
At this point Mortal Online is M rated 18+, a final rating will come closer to release but is very likely to be the same.
Release dates are NOT mentioned in any earlier announcements. In other words, since you need your hand held - this is the FIRST mention of a release date by MO.
What else does it mean? You're wrong. Way wrong in fact. Release has so far been pushed back a month, might be pushed back some more and from most reports it probably should be.
So what you're harping about is getting a box that would likely contain an outdated client that you would just have to update anyway. What EXACTLY is your point here?
You would have had a box that wouldn't have given you anything more that what you already had - access to a beta client. The game was set to SHIP in Sept, but not RELEASE until Q4. It's all spelled out for you right there. You're complaining about not having a shiny box and dvd that wouldn't do anything for you.
Again...let me clarify.....if you had gotten your box in September and even if the game had released in October you would have sat there with a box that didn't actually do anything for a full month or more.
So, let's time line it - You get your box in the first week of September. Game releases at the EARLIEST in October. That means you have a shiny box and a dvd that don't do anything for the entire rest of September and all of November. Judging from your reactions here you probably would have still complained if you had gotten the box on time because you clearly thought that SHIPPING meant RELEASE, when it did not. SV was very clear about the difference here, it's not like they used tricky wording or something....your anger is your own fault.

all admit beta sucks right now cause of bad timing and the holidays and but this next week server will stablize again after some patching. theres beent ime beta hasnt sucked just when a bad bug hits like right now. at least the game has no nda so they not hiding anything
We will start sending out the Boxed Edition directly after Christmas.
This is not something that we could anticipate, since there are other parties involved in the production of both the boxes and the Limited Editions.
Unfortunately we ran into a problem with the artbook for the Limited Edition, which means that we will be sending those out around the end of January. Customers who bought the Limited Edition will be compensated with one week additional free gametime.

Many jumped on board, many others (including myself) decided then and there to just wait and see exactly what this game was when it released.
I sympathize with anyone who is blindly ripped off (mourning, D&L), however that is not the case here. Anyone pissed now really only has themselves to blame. The developers themselves warned that this game was a risk, if you took it. I really can't feel sorry for you for that , especially considering most indications say this game is going to release at some point.
Secondly this is software we are talking about, set backs are the norm. They're announcements were for a q4 launch, with the possibility of setbacks. There was no lie here, that I can see.

Yah they said awhile ago that the game would be feature complete, but not everything would be 'fully enabled'.
I mean, to be frank, most mmo's release with something missing or incomplete. WoW did, Eve did, EQ2 did, FE did, CO did uhh....I guess I could go on. It's sandbox....part of that meaning is that a huge portion of 'stuff to do' comes directly from players....doing stuff.
Take a look at Eve. There really isn't much to do on the PvE side of things. The main thrust of the game comes from pvp and both individuals and corps interacting on pvp terms. If you didn't know that about the genre then I inda don't feel sorry for you teehee.
Oh and as far as being upfront....wtf are you talking about? The NDA was lifted awhile ago, any question asked in the IRC or on the forums is usually answered by a dev. Their ENTIRE beta plan was listed and updated regularly, everything they did they flat out told everybody why they were doing it and so on and so forth.
The devs most full of shit? Tasos and his underlings over at DF. Every single time a release was announced Tasos would be all, 'Hey! We're making God in a box here! It's gonna be awesome and fully complete and have all this stuff and it won't be pushed back again! Yeah!' then the day before release they would push the date back.
I haven't seen devs be this in touch with the community in a long time. Mebe joo need to get out more ^_^
I too paid for beta, thinking I would avoid a darkfall like release (Limited Copies) But as the development progressed (If you want to call it progression) Im pretty much at the point now where I already kissed my $75 goodbye, The game needs at least 6+ more months of development, If MO truly releases in a month ,....Bend over whilst griping your imaginary Loot Bag and Kiss MO goodbye

Still I mean this is what happens with a self-published game made by a rather small, brand new company. They aren't all ameteurs though. Some have worked at Ubisoft and I _think_ someone worked at Epic. Supposedly anyway, who knows if it's true.
Either way this is what happens with small-time devs that don't have a producer. Sure it means they don't have to split profits, but it also means that their dev money is split up into production as well as marketing...less money to pay their employees and extend liscences so less dev time.
They had always planned on releasing with the game being feature complete, but not with everything fully enabled. They said that awhile ago so it shouldn't be surprising. If they release with everything in that they said would be in how they said it would be then I'm sure it will do fine. We'll see. Doesn't bother me since I'm just taking a 'wait and see' policy here. I thin that this entire market is pretty much poisoned against full-loss, open pvp games at this point though. There are specific groups of people responsible for this....which I have always found odd since whenever the games they abuse and destroy become ghost towns they always bitch for another one.

These are the facts....mostly anyway. You can continue to ignore or dispute them as much as you want, but you have already lost. Oh and if you're still butthurt about no refunds then I guess you have now learned a life lesson that your parents should have taught you years ago. It might be shady, but so is what the Columbia Record Club does or did...I have no idea if they're still around. And SV was FAR more clear about the no refunds policy.
You seem to fail to grasp the concept that you are wrong, more than once in fact. There is a WHOLE big crowd of people out there just like me who saw that 'no refunds' snippet and steered clear. Yep food industry has a no refund policy. The problem is if I bite into my taco and find something that isn't supposed to be there, an undercooked product or find it to be spoiled that no fefund policy goes out the window.
Yeah, apparently you can't force someone to pay for something that wasn't cooked properly... but hey I am assuming you were hoping this wasn't pointed out.
You can not enforce a no refund policy on a product that does not work.
You can not enforce a no refund policy for a product that the consumer may one day see. It must be shipped when you stated it would or in a reasonable time frame after. If it isn't going to ship when you stated it would it's your responsibility to try and smooth things over with your consumer with discounts or other forms of compensation and ultimately give them a refund if that is what they desire. "Someday" is not what was agreed to and is not a time frame SV can legaly use to keep the money from the pre-orders.
SV: I know we stated September, but we have a no refund policy and they will still likely recieve there order someday....
A statement like that just doesn't stick lol.
Bottom line is regardless of how you, I, SV, or anyone else feels. SV broke the agreement and there fore there consumers are no longer bound by it. That no refund policy went out the window completely as soon as they did. In any event it's not like that no refund policy held water prior to recieving the product anyways. Until it's shipped, it's not a completed transaction. You can change your mind prior to shipping.
And no lol, beta is not what was purchased.

It's funny everyone say's they havent recieved anything yet when the client have been open for download since the launch of the shop.
Grow up, relax and dl the client and you can play. You WILL get your box even if it will be 1 month late since last update!

That's basically the only thing people paid for. Now that we see beta sucks and we want our physical products shipped -- there are no responses, emails, updates from SV other than maybe a month ago, where they say "Sorry".

Alright, since you seem so stuck on this whole September release deal being stated in July I've taken the time to prove you wrong. This is from the second newsletter in July and the only one that talks about release dates.

The Beta is divided into Blocks of 2.000 players each, depending on buying-order. Every second week 2.000 additional players will be able to enter the Beta. The full schedule is as follows:
July 20 Block A (including 999 Limited Editions)
August 3 Block B
August 17 Block C
August 31 Block D
September 14 Block E
The Digital Download only version will go on sale a week later than the Boxed Version and The Full Loot Bag as previously stated in the shop. This is because we hope to sell the physical products first, as they are a big cost to us if they sit on our shelves.
Shipping is included in the price for the physical products.
The physical products will be shipped from Sweden around September. Further updates before the launch of the full game will be shipped free of charge in connection to the launch. When buying a physical version you are also allowed to download the game, and play it in your corresponding Beta block.
The launch of Mortal Online is planned for Q4 2009 (Oct-Dec). This is not set in stone however, as we want all core features to be in place and properly tested before charging monthly subscriptions. We do not guarantee a specific release date for Mortal Online.
At this point Mortal Online is M rated 18+, a final rating will come closer to release but is very likely to be the same.

Release dates are NOT mentioned in any earlier announcements. In other words, since you need your hand held - this is the FIRST mention of a release date by MO.
What else does it mean? You're wrong. Way wrong in fact. Release has so far been pushed back a month, might be pushed back some more and from most reports it probably should be.
So what you're harping about is getting a box that would likely contain an outdated client that you would just have to update anyway. What EXACTLY is your point here?
You would have had a box that wouldn't have given you anything more that what you already had - access to a beta client. The game was set to SHIP in Sept, but not RELEASE until Q4. It's all spelled out for you right there. You're complaining about not having a shiny box and dvd that wouldn't do anything for you.
Again...let me clarify.....if you had gotten your box in September and even if the game had released in October you would have sat there with a box that didn't actually do anything for a full month or more.
So, let's time line it - You get your box in the first week of September. Game releases at the EARLIEST in October. That means you have a shiny box and a dvd that don't do anything for the entire rest of September and all of November. Judging from your reactions here you probably would have still complained if you had gotten the box on time because you clearly thought that SHIPPING meant RELEASE, when it did not. SV was very clear about the difference here, it's not like they used tricky wording or something....your anger is your own fault.

I remember from the start of this forum on MMORPG.com, the heated debate caused by this very fact. They planned to release a half finished product and build from there. Many jumped on board, many others (including myself) decided then and there to just wait and see exactly what this game was when it released.
I sympathize with anyone who is blindly ripped off (mourning, D&L), however that is not the case here. Anyone pissed now really only has themselves to blame. The developers themselves warned that this game was a risk, if you took it. I really can't feel sorry for you for that , especially considering most indications say this game is going to release at some point.
Secondly this is software we are talking about, set backs are the norm. They're announcements were for a q4 launch, with the possibility of setbacks. There was no lie here, that I can see.

It's sandbox....part of that meaning is that a huge portion of 'stuff to do' comes directly from players....doing stuff.
Take a look at Eve. There really isn't much to do on the PvE side of things. The main thrust of the game comes from pvp and both individuals and corps interacting on pvp terms. If you didn't know that about the genre then I inda don't feel sorry for you teehee.
Oh and as far as being upfront....wtf are you talking about? The NDA was lifted awhile ago, any question asked in the IRC or on the forums is usually answered by a dev. Their ENTIRE beta plan was listed and updated regularly, everything they did they flat out told everybody why they were doing it and so on and so forth.
The devs most full of shit? Tasos and his underlings over at DF. Every single time a release was announced Tasos would be all, 'Hey! We're making God in a box here! It's gonna be awesome and fully complete and have all this stuff and it won't be pushed back again! Yeah!' then the day before release they would push the date back.
I haven't seen devs be this in touch with the community in a long time. Mebe joo need to get out more ^_^
