This means the information before the court is considered substantial (meaningful) and revelant (important to the laws of justice) as well ascan be supported by evidence (means there is sufficient proof). A blow to the defense of "irrevelant" and "we will not answer" from Farlan, NPC and C. Jacquet. ALso, it would appear that their own counterclaim should now, in most probable circumstances, re-review their own allegations against Mr. _Pix_. Hats off to you Mr. _Pix_. The train is indeed still on the tracks and it would certainly appear as it is gaining speed and cannot be stopped until its destination is achieved.

So to comment this advertisement trailer quickly: we can see that it is mainly presenting video sequences from the 2003-2004 DnL trailers (apart from the section dedicated to Voyage Century and Alone in the Dark , which, for the latter, you must certainly acknowledge, cannot decently have anything to do with NPCube/Farlan/ BigWorld or SnailGame). Anyway...what I cannot but clearly point out is that in the main part dedicated to DnL, it presents excerpts from a VWORLD video shot in 2005 and illustrating features of VWorldTerrain which are NOT included in Dark and Light.
For thruth's sake, nothing better than proof-in-point images: link on VWORLD's Gallery, in which the reader may find the original video at the bottom of the page: http://www.vworld.fr/Gb/GBvideos.htm
Therefore, as of today, not only do SnailGame/ Farlan/NPCube (who else???) use videos that do not belong to them, but they blatantly truncate the original VWORLD video by cropping the top and bottom little details, like you know, small insignificant stuff like logos, comments, etc.

Howdy IK ! Don't get me wrong, we should all be willing to forget DnL, but with regards to _Pix_ I think he has a point and a right to get paid for his technology. Just my opinion is all.

Sometimes I' m thinking in fact I am asleep and at some point I will wake up from this nightmare. Especially when I read some posters recent ineptitudes to try once more to bully people.
Hmmm... what an interesting thread on the official boards. I am learning there than DnL fanbois are also Pix hatebois. Particularly the famous IKShadow who, non content with having spread false rumors, still strives to shoot me down in flames. Maybe he is simply a bot, (badly) programmed by Farlan/NPCube. BTW, remember when he claimed that I had already lost a previous case against Farlan (or anyone else)? I know for certain now who told him this and who asked him to spread these rumors: Farlan/NPCube themselves did since I was told by members of the new developement team at NPCube that their management had told them that there was no problem with me, that there were no Intellectual Property issues on the dev since I had already lost a case on VWorldTerrain IP property! This is beyond all expectations!!!! And before I came along with three bailiffs, upon court order, to make a report on NPCube's non-authorized usage of the technology two weeks ago, most of NPCube's programmers were far from believing that they were in fact hackers. Some knew about it but I guess did not want to rock the boat not to lose their job. I am therefore not at all surprised to see that the systematic truth hiding process continues: AD locks each and every thread mentionning the issue, particularly those linking www.pourieux.com. They are by this very fact acting as accomplice with NPCube/Farlan. I already sent them a read receipt e-mail stressing the partial attitude they were taking on in their community management and public statements. They acted just like NPCube: no answer. For the record, sorry this is going to be quite boring, but apparently a few more facts need to be stated :

FARCELAND/NPFLEECE threw the blame on _Pix_ simply because he was there. Look at allllll their other excuses for everything else.

People need someone to hate ? Wow, interesting concept. To me, it's not reasonable to consider people "need someone to hate". Personally I don't "need someone to hate". But if there is anything that I truly can't stand it's bad faith, bad ethics, disinformation practises and counting on human credulity to make money.

I think you understand what i am saying. they needed someone to blame. and everything seemed to be going good until PIX left. (i am not blaming PIX. just tring to let him see it from some of the players that where up set at him. (not that they are right or wrong to be upset at him. just that i can see how they might feel.)
as i also see how PIX feels wronged by the players that are upset at him. here he put his lifes work in to a game for them. and alot of work and then (np3 done not give him credit for it, and the players become mad and blame him. as for what NP3 or farland is thinking as much time as i have put in to this. i really have not a clue.
maybe they want to remove all of Pix work so they do not have to give him anything. i think all he wanted was the Vworld logo on the start up.
if that is all he wants why not do that. unless they feel him leaving broke that deal some how. but he did not leave until after they did not put his logo on the start screen. see why take the logo off? i do not have an answer to the questions i would like to know. other then farlan and NP3's left hand does not know what there right hand is doing. still the game could be saved. but i think it will take someone else buying the rights and remaking it. before most of the people will come back. and even then it going to take some work to bring them back. but i still like the idea of what DNL could have been. should have been.

As to why they do not to admit they are still using VWT, I think this is simply because they want to re-sell it.
And I never said also I was not able to sue them, and I was lacking proofs, far from it. You should know one generally seeks amicable solutions before entering the court ways, which automatically means going the long way.
BTW, 8 months ago now, Farlan did not hesitate to announce they were going to sue me (supported by AD and a few fans' allegations). So it would be only too fair that you consider things the other way around: Farlan was not able to sue me. This at least would be true.
A video presenting NPCube /SnailGame's partnership is broadcasted on the Internet. This video, a GamesTV report in Chinese, shows many video sequences of Dark and Light in its 2003-2004 version and illegally makes use of 26 seconds of video sequences from a 2005 VWORLD video, still available today on VWORLD's gallery. VWorldTerrain's logo has been cut off on these images, which are presented as being in-game from Dark and Light. On the other hand, NPCube's name and Dark and Light's logo in Chinese appear on many occasions throughout this TV report. This video is broadcasted on many Chinese portals, and is linked to from the offficial community dnl.net website, among others.
This video also presents an interview in French of Mr Stéphane Quilichini, Lead Game Designer of Dark and Light. Mr Quilichini claims making use of a seven-year-old technology, therefore a technology which has already been existing at least two years prior to the forming of NPCube.
A comparison video, which shows the obvious counterfeiting VWORLD is the victim of, is posted on YouTube. This short video also shows extracts from Mr Stéphane Quilichini's interview:
December 10, 2007- [VWORLD]
On December 10th, 2007, VWORLD issues a formal notice ordering NPCube to suppress the counterfeit video serving the promotion of Dark and Light. NPCube is also ordered to publish a press release stating that the sequences from a VWorldTerrain 2005 video, which are illegally used in order to promote Dark and Light, are not taken from that game, and are not NPCube's, nor SnailGame's, nor Farlan's property. Upon VWORLD's demand, a bailiff's report is established on the counterfeiting of this video. NPCube does not reply to the formal notice and the counterfeit video is still used on dnl.net in 2008 (here, here or there) in order to promote Dark and Light, without any intervention on the part of Alchemic Dream, company in charge of community management, in order to censor this illegal video.
December 24, 2007- [VWORLD]
Due to the illegal use of a VWORLD 2005 video in order to serve the promotion of Dark and Light in 2007, VWORLD has referred the matter to competent authorities so as to put an end to this counterfeiting without delay and obtain redress.

Mid 2005, NPCube, represented by its Managing Director Mr César Jacquet, had lodged a complaint against one of its salaried employees, and had associated in the subsequent court action with the public prosecutor. The employee was charged with theft, notably to the benefit of VWORLD. Consequently, he had been indicted and the case had been brought before the Magistrates' Court of Saint-Denis, Reunion Island.
NPCube has been non-suited, a first time on April 3rd, 2007, a second time on appeal on July 23rd, 2007 and a third time before the Court of Cassation on January 8th, 2008. Mr Christophe Nazaret and Mr Laurent Paret, NPCube's associate members, had testified against their ex-salaried employee, who had been dismissed earlier in 2005.
In its allegations, NPCube had implied that VWORLD had been pirating its work via the Internet and had been stealing confidential data from NPCube through two of NPCube's employees. VWORLD did not discover such serious accusations had been levelled by NPCube against VWORLD (as early as 2005) until April 2007, when the first non-suit decision was delivered by the Court of Saint-Denis, Reunion Island.
Separately, NPCube has been convicted on last December 3rd, 2007 by the Labor Relations Board of Reunion Island, for moral harassment and dismissal without sufficient grounds or justified motive of one of its ex-salaried employee, who had also been dismissed in 2005.

Let me get this straight. Back in '05 Farlan/NPC accused an ex employee of stealing and such right? The employee however was found innocent, or no grounds, but Farlan/NPC was in turn convicted of harassment and what I would imagine is the same as wrongful termination and other bs towards this employee as of Dec '07....right? Holy cow.....LMAO
There are 2 separate cases:
One ex-employee was accused by NPCube in 2005 of having stolen confidential data for VWORLD. NPCube lost 3 times, and went as far as pushing the matter into Court of Cassation (which I believe is in France the equivalent of the Court of Appeal, that is to say they insisted as far as the legal system permits) . It took 2 years and what is most incredible is that they tried to have a Court believe that VWORLD was stealing confidential data from NPCube through twoof NPCube's employees (!), so that their "work " appeared magically on the VWORLD website.(!!).
The other case is about another ex-employee who was fired by NPCube in 2005. She sued NPCube for moral harassment (for the record, she spent three weeks in hospital) and for unfair dismissal. She's just won her case against NPCube: it took 2 years also
These two ex-salaried employees of NPCube are talented graphic artists and were part of the initial 2003-2004 team, which allowed Dark and Light and Farlan/NPCube to get so much hyped. This team was completely destroyed between 2004 and 2005.

I think you understand what i am saying. they needed someone to blame. and everything seemed to be going good until PIX left. (i am not blaming PIX. just tring to let him see it from some of the players that where up set at him. (not that they are right or wrong to be upset at him. just that i can see how they might feel.)
as i also see how PIX feels wronged by the players that are upset at him. here he put his lifes work in to a game for them. and alot of work and then (np3 done not give him credit for it, and the players become mad and blame him. (not all of the players just some of them) is has to be vary upsetting.)

There's nothing awkward in this "situation" except for Farlan. I never said NPCube did not accept VWORLD as subcontractor, not at all. Sorry if you "understood" this way but what I said was:
October 2004: NPCube's management doesn't succeed in proposing a contract respecting my IP rights. Consequently, VWORLD team is no longer working on the project.
As to why they do not to admit they are still using VWT, I think this is simply because they want to re-sell it.
And I never said also I was not able to sue them, and I was lacking proofs, far from it. You should know one generally seeks amicable solutions before entering the court ways, which automatically means going the long way.
BTW, 8 months ago now, Farlan did not hesitate to announce they were going to sue me (supported by AD and a few fans' allegations). So it would be only too fair that you consider things the other way around: Farlan was not able to sue me. This at least would be true.

A video presenting NPCube /SnailGame's partnership is broadcasted on the Internet. This video, a GamesTV report in Chinese, shows many video sequences of Dark and Light in its 2003-2004 version and illegally makes use of 26 seconds of video sequences from a 2005 VWORLD video, still available today on VWORLD's gallery. VWorldTerrain's logo has been cut off on these images, which are presented as being in-game from Dark and Light. On the other hand, NPCube's name and Dark and Light's logo in Chinese appear on many occasions throughout this TV report. This video is broadcasted on many Chinese portals, and is linked to from the offficial community dnl.net website, among others.
This video also presents an interview in French of Mr Stéphane Quilichini, Lead Game Designer of Dark and Light. Mr Quilichini claims making use of a seven-year-old technology, therefore a technology which has already been existing at least two years prior to the forming of NPCube.
A comparison video, which shows the obvious counterfeiting VWORLD is the victim of, is posted on YouTube. This short video also shows extracts from Mr Stéphane Quilichini's interview:
December 10, 2007- [VWORLD]
On December 10th, 2007, VWORLD issues a formal notice ordering NPCube to suppress the counterfeit video serving the promotion of Dark and Light. NPCube is also ordered to publish a press release stating that the sequences from a VWorldTerrain 2005 video, which are illegally used in order to promote Dark and Light, are not taken from that game, and are not NPCube's, nor SnailGame's, nor Farlan's property. Upon VWORLD's demand, a bailiff's report is established on the counterfeiting of this video. January 2008- [NPCube - Other cases]
Mid 2005, NPCube, represented by its Managing Director Mr César Jacquet, had lodged a complaint against one of its salaried employees, and had associated in the subsequent court action with the public prosecutor. The employee was charged with theft, notably to the benefit of VWORLD. Consequently, he had been indicted and the case had been brought before the Magistrates' Court of Saint-Denis, Reunion Island.
NPCube has been non-suited, a first time on April 3rd, 2007, a second time on appeal on July 23rd, 2007 and a third time before the Court of Cassation on January 8th, 2008. Mr Christophe Nazaret and Mr Laurent Paret, NPCube's associate members, had testified against their ex-salaried employee, who had been dismissed earlier in 2005.
In its allegations, NPCube had implied that VWORLD had been pirating its work via the Internet and had been stealing confidential data from NPCube through two of NPCube's employees. VWORLD did not discover such serious accusations had been levelled by NPCube against VWORLD (as early as 2005) until April 2007, when the first non-suit decision was delivered by the Court of Saint-Denis, Reunion Island.
Separately, NPCube has been convicted on last December 3rd, 2007 by the Labor Relations Board of Reunion Island, for moral harassment and dismissal without sufficient grounds or justified motive of one of its ex-salaried employee, who had also been dismissed in 2005.
