March 4, 2008- [VWORLD - Commercial Court of Paris]
The Commercial Court of Paris declines itself incompetent to judge the counterfeiting of VWORLD 2005 video sequences by NPCube, sequences used to promote the Dark and Light MMORPG in 2006 and 2007. NB: NPCube did not bring any submissions in reply to the plaintiff's writ issued on February 25th, 2008, for summary judgment.
VWORLD will therefore submit the case to another court of law in order to obtain redress.
March 6, 2008- [VWORLD - Paris Court]
The President Judge of the County Court of Paris accepted the principle of application for summary jugdment submitted by VWORLD, so as to get a court ruling on the counterfeiting of VWORLD 2005 video sequences by NPCube, sequences used in order to promote the Dark and Light MMORPG. The speeches are to take place on March 19, 2008.
_Pix_, you must have the patience of a Saint. I will admit if the same thing would have happened to me, I'd have probably flown to Reunion Island and done more than given the folks at Farlan a good talking to.
Well, hopefully you can get this all resolved as soon as possible and in your favor.
Seems to me the court should have known they didnt have the capacity to decide this case long ago. At least they got the legal procedures correctly, which Farlan still seems to not understand.

Anyone got a link to " Scraper" It is great that everyone is taking and only getting to read 1 side of the story as well. If this technology was so important or so great , why aren't game developers banging down the door to use it. SImple fact that is is technology used for destruction. French game designers have nothing to do with what Pix is doing, Pix is mad that his technology failed in the game market, and wants to make everything fall on Farlan and npcube. Bottom line the technology failed, get over it .
We've gotten both sides.
On one side we have NPcube/Farlan who lied from the beginning about the game to the consumers paying pre-orders; lied to the consumers who paid for pre-order and weren't going to stay by saying it was not the real game ( when in fact it was ); charged consumers money (hundreds of dollars at a time in some cases ) months and even YEARS after the person(s) stopped playing; have continually been caught in lies and deceptive practices in many venues including this website, other gaming websites, their own websites, and even in court proceedings; continue to lie to consumers by trying to pass off screens and videos from 2005 ( which they had no legal right to use in the first place due in part to the dispute at hand ) as current gameplay; and have tried increasingly to be deceptive in the usage and time of usage of the VWorld tech in order to futilely try to win the case brought against them by _Pix_.
Then we have _Pix_, who has not been caught in even one lie yet as far as we know anywhere, virtual or otherwise, who has maintained the same story from the beginning ( compared to Farlan/NPcube who have changed their stories countless times in the court proceedings alone, when one lie failed they conjured yet another ), who has been the one to continue the court process without asking for, or causing, delay after delay after delay ( as NPcube/Farlan have done from day one ).
So, you'll forgive me if I take the word of one man who has shown no appearance of falsehood the entire time over the word of multiple people who have done nothing but get caught in one lie after another.
You are of course free to believe what you want, but you might wanna keep a hand over your wallet. Because if you're actually gullible enough to take Farlan/NPcubes' side in tis, they'll probably be asking you for a handout next. Especially when this is all over and their sorry butts are washing car windows for spare change at busy intersections ( they'll need capital to buy their first squeegee and towels, after all ).

Hmmm, let me count ...as of today, and with the passing of time, we have 5 Bailiff's reports in fact :
2005: report upon the fact that they communicated upon their usage of VWorld technology
2006: in-situ report on their usage of (some of the) 1996-2002 procedural algorithms of VWorld technology
2007: report upon the fact that DnL was distributed worldwide
2007: report on the usage of 2005 VWorldTerrain video sequences to promote DnL in 2007 (without the VWorldTerrain logo)
2008: report on the usage of the same video sequences to promote DnL in 2006. (but with the VWorldTerrain logo this time)
Plus, of course, the various formal notices VWORLD and I sent since 2004.
What I truly find fascinating is that their bailiff's report is dating at an earlier date, you're right, and at a date I was still working on the game. You know, human nature, most fascinating (hasn't changed a bit since the Roman times).
@solareus: the issue here, solareus, is that you picked up the wrong technology evidence to sustain your laggy claim. As far as I know, VWorldTerrain is no server technology, so cannot simply be held responsible for lag issues (although can reasonnablv be fairly credited for providing massive terrain, and not only Dark and Light's) . Besides in your assumptions you're implying that there was "a" technology created for Dark and Light, which again needs to be corrected, since, as far as I know, both server and terrain technologies used for Dark and Light were not created specifically for that game.
Think the real issue is that the technology failed in the gaming format, and everyday the day game server is up and everyday people play through massive chunking, lag and glitches, it is a constant reminder of failed technology . If this game had become a massive success would we all be going through this right now, I doubt it cause then it would be showcasing the technology in a real application. The fact that the technology itself is flawed , as well as the the flaws throught out the games handling are testiment that the real issue is that Pix doesn't want to be associated with the game, because the technology he created for DnL , failed. As far as being gulliable , you are about wrong as it can be, I been gaming for a long time, I would never buy into something I tested , and doesn't function as intended, no matter what the developer said, but apparently the majority iof you whining on this forum, tested the game, in beta , and still bought it.. the only one at fault is yourselves for getting suckered .
_Pix_ isn't declaring whether or not the technology succeeded or failed ( in fact, if memory serves, he's even stated the technology in VWorld was never originally meant or intended for use in a game such as DnL, but was adapted as best as possible because this is what Farlan wanted ), so the technological feasibility isn't even in question. The lawsuit has been, and remains to be, the legality of using technology you do not own for your own profit, which is what Farlan/NPcube have done.
And for the record ( again ) I never lost any money to Farlan/NPcube myself, as I seen the disaster coming from beta. But I won't stand by and let people be fleeced by a dishonest and disreputable company without at least informing them of the facts, as well as denouncing the claims made by DnL fanbois who continue to try to sucker people into the game ( this is not directly aimed at you ).

NPCube was also claiming it was making use of a "SCAPER" technology for its terrain needs. NPCube was demanding to be duly compensated.
The Court has reached a verdict on last March 13th: NPCube sees its case dismissed by the Court upon all requests and has been fined for damage to VWORLD.

I guess you're missing the point once again solareus. This was the counter suit by NPCube against VWorld, not the main suit of VWorld suing NPCube. So that case is still not settled by what I'm reading, although it looks very good for _Pix_ when the counter suit is dismissed and NPCube is fined.

So wait, they were accusing you of having damaged the partnership with Snailgame.....how then are they saying that things are going along swimmingly and all the wonderful things the chinese version is doing and how it is for Farlan???
