Then...How can the EQ EMU be possible???

 why has SOE done nothing to stop swgemu? I hear that a playable PRE-CU (pub 12.1) game could be out as soon as Q4 2007. It appears that SOE is so arrogant to think that the NGE is better and that no one will want to play an EMU. They let the EQ EMU go with it....WHY?

My point is, that the EMU people are already "tampering" with the code and SOE knows about it and does nothing to stop them. I dont think they even care. The word is that the EMU is not illegal so long they dont make money from the project.

This is not the first time someone has developed an EMU and SWG wont be the last. The only way I see this project failing is if SOE comes out with pre-CU servers and the project loses community support.

JUST LOOK AT THE EQ EMU...Everquest is owned by SOE. If it works for EQ it can work for SWG!

    They received a cease and desist letter a while back.

    It comes down to this:

    damages vs. cost of lawsuit.

    When first becomes significant with respect to the other, they move in. Legal or not doesn't matter here, the DMCA is such a nice thing, that it can be abused for just anything, especially anything with regard to software copyrights.

    And if the emu really takes until Q4 2007, then they'll miss the bus by a long shot. By that time, even the die hard fans will move on several times over.

    If they operate from a country that does not regard international copyright laws will they be able to pull it off with out going to court?How the hell could SOE enforce or sue if the pirate devs were operating in N.korea or China or some east European country?

    Pirating in China = bad idea (death sentence and similar)
    N Korea, while less active in this sense lacks the infrastructure, and finding someone to run such a server might not be all that easy for a fan based project.
    Eastern Europe, counting the countries that have the infrastructure, all have active BSA and related agencies.

    Realistically, you need to host it in US or Europe. If you're smart, you can avoid legal issues. It was and is being done for other emu projects.


    The key here is to find a way not to break the law, not move to a secluded island. It can all be done without violating the copyrights, as long as you're smart, and don't become too big.

    soe doesnt care about em cuz emu seems impossible with those emu coders..

    if real coders worked on it, it would be up one day.. but with those kiddies, impossible

    No emulator has ever been shut down by a lawsuit.

    So long as they:

    1. write their server code from scratch  (which they are doing)
    2. don't steal any SOE code  (which they are not doing)
    3. Charge for a SWG online service  (they are not going to do this)
    4. Steal the client (they are already telling people to go buy the client)

    If you are not doing any of those things you are not violating copyright law.  You would be violating SOE's EULA, but the worst they could do to you for that is ban your account.

    There is nothing that can be done to them legally.  It's the same thing as a 3rd party making a toner cart that is compatible with, say, a Lexmark printer.  Which Lexmark hates because they make huge markups on their original toners, and recently, they started chipping their toners so that only theirs would work.

    A company reverse engineered the chips so their 3rd party toners would work.  Lexmark sued under the DMCA.  They lost.

    Same thing would ultimately happen here.

    Indeed, if they DID sue people making/running a pre-CU emu server, there would be an interesting countersuit that could be brought against SOE...  The whole reason for the SWG emulator's existance is that people want to play the original game, which SOE refuses to provide.  It's not being made so that people can play SWG for free, it's being made because people want to play a game that they BOUGHT that SOE changed against their will, ie: Sony is creating the need for the emulator by not providing the service those players want, thus THEY are partly responsible for it's need.

    I think SOE would send out some threatening letters, but they'd really be stupid to sue.  For one thing, they'd look really bad.  For another thing, there is a great chance they would LOSE.  I could see the EFF or even the ACLU wanting in on a case like this... 

    BTW, I am an EFF member.  You should be too.

    A lawsuit by SOE against people who want nothing more than the game they bought and paid for and loved back would be a CERTAIN loser in a jury trial and they know it.  Especially when the defendants could bring out example after example of SOE removing things, professions, features, whole systems from the original game (and is one of the reasons for the emu's existance)

    No, SOE doesn't want to go anywhere NEAR a courtroom over SWG.  Not unless they are really REALLY stupid.

    Hmm. How do you legally obtain a pre-cu client? It's not available for download anymore.

    If you buy the starter kit you have the pre-Cu client, JTL, and the CU patches and the NGE patches.

    The emulator will patch over those so that you are reverted to a 12.1 client.  The files are all there.  Go look in your SWG directory sometime, you will see all the patches.

    Because Smed made a post that said if they managed to do it he would hire them. Legally. SOE doesnt have a leg to stand on anymore. I could see the court case now.

    SOE Attornies - Your Honor they willingly and with forethought stole our code when they REed the EMU game.

    Judge - What do you have to say about your President telling them he would hire them if they did make an EMU SWG?

    LOL....Maybe the current SOE devs are too stupid to create a pre-CU server. Maybe, SOE is looking for someone to do it for them...lol

    How can you get a lawsuit over something that dosent exist? Until the people suposedly doing this EMU show their faces, show some real physical evidence of the EMU, and/or start the thing running, its nothing but word of mouth. In the future I believe Google will control every aspect of the internet, can I take them to court now?

    Well Smed is a dumbass that much is true. But what I mean is who would SoE sue? From what we have seen these EMU people are just words on a website. We dont know if they are even really making one. And until they come up with some hard evidence of such, SoE cant even get their feet on the ground. I couldnt give 2 shits about this whole EMU thing to be honest, but the reason I replied here is because there are alot of people who do care about it, and no matter how hard you try you cant just ignore it. So the next best thing is to at least try and respect their stance, although i disagree with it.

    There's an easy test. Start handing out cracked versions of XP to all your friends for free, and tell Microsoft you're doing it. I'm sure Bill won't mind.

    I respect your views....

    However, PRE-CU servers from EMU or SOE will happen within the next 1- 2 yrs. It will happen because too many people want it. There is nothing...NOTHING from a legal standpoint to stop the EMU guys from making the EMU. Unless they change the laws of this country, the project will go forward. There is nothing SOE can do about it.

    Honestly, I really dont think they care about the EMU.

    To be honest, as much as I miss the old SWG by the time Q4 2007 comes around I'll have moved on.  WAY on.  By then I should be playing WAR or Conan (or at least getting ready to play them).

    Right now I'm happy just playing DDO and having fun there, if it was out now then I'd probably jump on it but in a years time?  Well the next gen of MMOs would have to be really bad for me to want to go back to SWG.

    Wake up people, SWG was never that great even before the CU!  It was the people who played it that made it fun and I don't know if you can ever get that back, not even with the EMU.

    My friend there are other emulators out there. NOT ONE!!! has been taken down..AS LONG AS THEY FOLLOW THE LAW...There is nothing that can be done to them.

    NGE probably wouldn't have been that bad IF it -

    1) It hadn't been full of massive bugs
    2) Hadn't been dropped on players well into a game a few years old.

    If the game had started out with an NGE style of play then it might not have been so bad, I'm not saying it would have been to everyones taste but it's fair worse to have it dropped in your lap a few lears later.

    I'll play Conan because I love the Conan IP but right now WAR is the game I'm most looking forward to.

    NGE would have been worth a dime if they gave a shit about the current players at the time. Instead they made a bunch of crap for levels 1-30, aka new players that they hoped to draw in.
