You need to have a staff to cast spells. You can get one from the newb vendor for 20 gold if you want to replace your starter sword, or 100 gold if you want to buy a new newb item slot.

I have v1.031.0 of the patcher. When I start it, does not try to install a update. It did try earlier, but it would not download anything. It would give a error message (incorrect file size). Any fix for this?

As previously said, there is no Developer quote that confirms or denies this. They have said it will be similar to Ultima Online from back in the day though, and shadowbane, and both of those games had stealing/thievery.
