Well we've been waiting for ages for the Escapist to do their follow up story, why should a lawsuit be any different.
It is possible Roberts pulled the invitation back and wouldn't let them come. So they are just waiting for the next shoe to drop. They never took back what they stated so it is clear they stand behind the story.

Very few successful games were made with CryEngine.
One of the reasons is that it's not intuitive or easy to use.
I played with it before, I don't make games but I do use CAD software. So I do know something about software.
Cinema 4D is intuitive to use for me....Maya is unintuitive......Crysis Engine was a nightmare.
Sure, I'm comparing an engine with 3D software, but I know intuitive software when I see it. CryEngine turns out to be a nightmare for most developers.

Or alternatively they are just biding their time and building a "stone bucket" of evidence to take to court if such a thing becomes necessary. If you take someone to court it helps your case quite a bit if you can prove you tried your best to settle the issue amicably before deciding to get the courts involved. Copyright infringement protection companies use this tactic all the time.
They'll never take it to court. To prove that the financial allegations are slander/libel they would have to actually open the books, something Roberts clearly doesn't want to do. Who can blame him really? Giving their million or so backers and thousands of critics the chance to second guess every last dollar spent is not an appetizing prospect even if there is no corruption.

Here's the thing, it's now CIG's money, which was donated to them to be used to make a game... how it's distributed is up to those in charge there (salaries)... They are accountable to use it properly, in order to complete said project. So yes it is okay for them to use that money... as long as they are doing right by those who donated. Otherwise they do open themselves up to legal action, which is what all of this hoopla has been about... the no accountability statement being thrown around over and over is pure bullocks.

If anything the longer it takes for them to conitnue the more likely it is they will have some pretty damning and concrete facts to put out there. I am sure they have plenty of 'good' stuff already but after what happened last time I suspect they will have the hammer in the next one, so when it does come out people who are defending CR/CIG might want to take cover.

Well, I certainly sent them the most damning rumours I heard from his old Origin co-workers. It would require a lot of research, and perhaps more resources than the Escapist might have.
Still, I think a shotgun approach of going through something like linkedin and contacting everyone who ever worked at Origin and Digital Anvil might yield some pretty interesting accounts.
If you are holding out for the perfect game, the only game you play will be the waiting one.

Only if the crytek engineers are less skilled that bioware and ea engineers were, and the crytek engineers in CIG have home turf advantage, they worked on the original engine, who knows what quacks worked on hero and if how and if they even helped for swtor

They opted to start with an existing engine rather than start from scratch. They opted for CryEng - availability of staff was probably a factor. Did they expect to have to do "a lot" of work? The sheer size of the Frankfurt team suggests yes.
The key now is the alpha. If updates continue then progress is being made and the discussion should be around new features, new capabilities and even is progress fast enough etc. If updates stop then people can get the "we said it was impossible quotes out". And the alpha is very public so we will know.
Until development dries up however raking up old comments - even if they were attributed - is meaningless. Visible progress trumps all.

I think that really depends on the quality as well as overall design of the game. If it's half assed, it won't take long before there is some kind of stink raised over it. It's too high profile at this point, that's my problem with the idea that there is no accountability.

Its very technical, watch the video of CR again, and if you do not understand the whole 'explanation' that CR is trying to describe, just shut up. It is not as simple as 'its not really working, so lets try tweak some more.' There is a big difference between making a 'makeshift' bridge that may or may not colapse after few usage, and a bridge that can withstand a thyphoon. This is engineering.
